StateCouncilDecisiononAmendingSomeAdministrativeRegulations

Inordertopromotestreamliningofadministrationanddelegationofpower,combiningdecentralization,andoptimizingservicereformsinaccordancewiththelaw,theStateCouncilhascancelledandadjustedadministrativeapprovalitems,pricereforms,andimplementedgeneralfeereductionsTheadministrativeregulationsinvolvedinthemeasureshavebeencleanedup.Aftercleaningup,theStateCouncildecidedtoamendsomeprovisionsof66administrativeregulations.

37.AmendthefirstparagraphofArticle9ofthe"RegulationsonCertificationandAccreditationofthePeople'sRepublicofChina"toread:"AchievingthequalificationofacertificationbodyshallbeapprovedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilandwithinthescopeofapprovalEngageincertificationactivities."

ThefirstparagraphofArticle10isamendedas:"Toobtainthequalificationofacertificationbody,thefollowingconditionsshallbemet:

"(1)Obtainthequalificationofalegalperson;

"(2)Haveafixedplaceandnecessaryfacilities;

"(3)Haveamanagementsystemthatmeetsthecertificationandaccreditationrequirements;

"(4)RegisteredcapitalNotlessthanRMB3million;

"(5)Therearemorethan10full-timecertificationpersonnelinthecorrespondingfield."

Article11isamendedtoread:"Foreign-investedenterprisestoobtaincertificationbodyqualificationsshallnotonlymeettheconditionsspecifiedinArticle10oftheseRegulations,butalsothefollowingconditions:

"(1)Theforeigninvestorhasobtainedtheaccreditationoftheaccreditationbodyofthecountryorregionwhereitislocated;

"(2)Theforeigninvestorhasmorethan3yearsofbusinessexperienceincertificationactivities.

"Theapplication,approvalandregistrationofforeign-investedenterprisestoobtaincertificationbodyqualificationsshallalsocomplywithrelevantforeigninvestmentlaws,administrativeregulationsandrelevantnationalregulations."

Article12amendmentItis:"Applicationandapprovalproceduresforcertificationbodyqualification:

"(1)ApplicantsforcertificationbodyqualificationshallsubmitawrittenapplicationtothecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilandsubmitawrittenapplicationthatcomplieswithArticle10ofthisRegulation.Documentsthatspecifytherequirements;

"(2)ThecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilshallmakeadecisionwhethertoapproveornotwithin45daysfromthedateofacceptanceofthecertificationbodyqualificationapplication.IfthedutiesofrelevantdepartmentsoftheStateCouncilareinvolved,theyshallSolicitopinionsfromrelevantdepartmentsoftheStateCouncil.Ifitdecidestoapprove,issueanapprovaldocumenttotheapplicant.Ifitdecidesnottoapprove,itshallnotifytheapplicantinwritingandexplainthereasons.

"ThecertificationandaccreditationadministrationdepartmentoftheStateCouncilshallannounceListofcompaniesthathaveobtainedthequalificationsofcertificationbodiesinaccordancewiththelaw."

Article13isrevisedtoread:"ForeigncertificationagenciestoestablishrepresentativeofficeswithintheterritoryofthePeople’sRepublicofChinamustregisterwiththeadministrativedepartmentforindustryandcommercebeforetheycanengageinbusinesswiththeiraffiliatedinstitutionsRelevantpromotionactivities,butcertificationactivitiesarenotallowed.

"TheregistrationofarepresentativeofficeestablishedbyanoverseascertificationagencyintheterritoryofthePeople'sRepublicofChinashallbehandledinaccordancewiththerelevantforeigninvestmentlaws,administrativeregulationsandrelevantnationalregulations."

Article26AmendmentThefollowingis:"Thecertificationbodymaydevelopthecertificationmarkbyitself.Thestyle,textandnameofthecertificationmarkformulatedbythecertificationbodyshallnotviolatetheprovisionsoflawsandadministrativeregulations,shallnotbethesameasorsimilartothecertificationmarkpromotedbythestate,andshallnothindersocialmanagement.Mustnotharmsocialmorality."

ThesecondparagraphofArticle46isdeleted.

InArticle55,the"qualityandtechnicalsupervisiondepartmentofthepeople'sgovernmentofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment"wasrevisedto"thequalityandtechnicalsupervisiondepartmentofthelocalpeople'sgovernmentatorabovethecountylevel."

Article58isamendedtoread:“ForeigncertificationagenciesthathavenotregisteredtoestablishrepresentativeofficeswithintheterritoryofthePeople’sRepublicofChinashallbebannedandafineofnotlessthan50,000yuanbutnotmorethan200,000yuanshallbeimposed.

"AregisteredrepresentativeagencyofanoverseascertificationagencyengagedincertificationactivitieswithintheterritoryofthePeople'sRepublicofChinashallbeorderedtomakecorrectionsandbefined100,000yuanupto500,000yuan.Ifthereareillegalgains,theillegalgainsshallbeconfiscated;thecircumstancesareseriousIftheapprovaldocumentisrevoked,itshallbeannounced."

Inaddition,theorderoftherelevantadministrativeregulationswillbeadjustedaccordingly.

Thisdecisionwilltakeeffectonthedateofpromulgation.

DecreeoftheStateCouncilofthePeople’sRepublicofChina(No.732)"DecisionoftheStateCouncilonAmendmentandRepealofCertainAdministrativeRegulations"onDecember11,2020,specifiestheeighteenth:deletethe"RegulationsonCertificationandAccreditationofthePeople'sRepublicofChina"Article11.

Article13ischangedtoArticle12,andthe"administrativedepartmentforindustryandcommerce"inthefirstparagraphisamendedto"marketsupervisionandmanagementdepartment".

Article32,Article35,paragraph1,Article36,Article52,Article64,paragraph1,Article65,paragraph1,and7aredeletedThe"inspectionagency"inthethirdparagraphofArticle10.

Article33ischangedtoArticle32,the"inspectionagency"inthefirstparagraphisdeleted,andthesecondparagraphisamendedasfollows:"Unappointedcertificationbodiesandlaboratoriesshallnotengageincertificationofproductslistedinthecatalogandinspectionandtestingactivitiesrelatedtocertification."

ChapterOneGeneralProvisions

Article1Inordertostandardizecertificationandaccreditationactivities,improvethequalityandmanagementofproductsandservices,andpromoteeconomicandsocialdevelopment,theseregulationsareformulated.

Article2ThecertificationreferredtointheseRegulationsreferstotheconformityassessmentactivitiesofcertificationbodiesthatcertifythatproducts,services,andmanagementsystemscomplywithrelevanttechnicalspecifications,mandatoryrequirementsorstandardsofrelevanttechnicalspecifications.

TheaccreditationreferredtointheseRegulationsreferstotheconformityassessmentactivityinwhichtheaccreditationbodyrecognizestheabilitiesandqualificationsofcertificationbodies,inspectionbodies,laboratories,andpersonnelengagedinaccreditationactivitiessuchasreviewandaudit.

Article3CertificationandaccreditationactivitieswithintheterritoryofthePeople'sRepublicofChinashallabidebytheseregulations.

Article4Thestateimplementsaunifiedcertificationandaccreditationsupervisionandmanagementsystem.

Thestateimplementsaworkingmechanismforcertificationandaccreditationworkundertheunifiedmanagement,supervisionandcomprehensivecoordinationofthecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,andthejointimplementationofallrelevantparties.

Article5ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilshallstrengthensupervisionandmanagementoftheactivitiesofcertificationtraininginstitutionsandcertificationconsultinginstitutionsinaccordancewiththelaw.

Article6Certificationandaccreditationactivitiesshallfollowtheprinciplesofobjectivity,independence,openness,fairness,honestyandcredibility.

Article7Thestateencouragesequalityandmutualbenefittocarryoutinternationalmutualrecognitionactivitiesforcertificationandaccreditation.Certificationandaccreditationactivitiesofinternationalmutualrecognitionshallnotharmnationalsecurityandsocialpublicinterests.

Article8:Institutionsandtheirpersonnelengagedincertificationandaccreditationactivitiesshallbeobligedtokeepconfidentialthestatesecretsandtradesecretstheyknow.

ChapterTwo:"CertificationBody"

Article9:ObtainingthequalificationofacertificationbodyshallbeapprovedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,andshallengageincertificationactivitieswithintheapprovedscope.

Withoutapproval,nounitorindividualmayengageincertificationactivities.

Article10Toobtainthequalificationofacertificationbody,thefollowingconditionsshallbemet:

(1)Obtainlegalpersonality;

(2)Haveafixedplaceandnecessary

(3)Haveamanagementsystemthatmeetstherequirementsofcertificationandaccreditation;

(4)TheregisteredcapitalshallnotbelessthanRMB3million;

(5)Therearemorethan10full-timecertificationpersonnelinthecorrespondingfield.

Certificationagenciesengagedinproductcertificationactivitiesshouldalsohavetechnicalcapabilitiessuchastestingandinspectionthataresuitableforengaginginrelatedproductcertificationactivities.

Article11Applicationandapprovalproceduresforcertificationbodyqualification:

(1)ApplicantsforcertificationbodyqualificationshallsubmitawrittenapplicationtothecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,andSubmitthecertificationdocumentsthatmeettheconditionsspecifiedinArticle10oftheseregulations;

(2)ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilshallmakeadecisiononwhethertoapproveornotwithin45daysfromthedateofacceptanceofthecertificationbodyqualificationapplication.WherethedutiesofrelevantdepartmentsoftheStateCouncilareinvolved,theopinionsofrelevantdepartmentsoftheStateCouncilshallbesolicited.Ifitdecidestoapprove,itshallissueanapprovaldocumenttotheapplicant.Ifitdecidesnottoapprove,itshallnotifytheapplicantinwritingandexplainthereasons.

ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilshallpublishalistofenterprisesthathaveobtainedcertificationbodyqualificationsinaccordancewiththelaw.

Article12ToestablisharepresentativeofficewithintheterritoryofthePeople’sRepublicofChina,anoverseascertificationagencymustregisterwiththemarketsupervisionandmanagementdepartmentinaccordancewiththelawbeforeengaginginpromotionactivitiesrelatedtothebusinessscopeoftheaffiliatedinstitution.However,certificationactivitiesarenotallowed.

TheregistrationofarepresentativeofficeestablishedbyanoverseascertificationagencywithintheterritoryofthePeople'sRepublicofChinashallbehandledinaccordancewithrelevantforeigninvestmentlaws,administrativeregulationsandrelevantnationalregulations.

Article13Thecertificationbodyshallnothaveaninterestrelationshipwiththeadministrativeagency.

Certificationagenciesshallnotacceptanyfundingthatmayaffecttheobjectiveandfairnessofthecertificationactivities;theyshallnotengageinanyproductdevelopment,marketingandotheractivitiesthatmayaffecttheobjectivenessandimpartialityofthecertificationactivities.

Thecertificationbodyshallnothaveaninterestrelationshipinassetsandmanagementwiththecertificationclient.

Article14Certifyingpersonnelengagedincertificationactivitiesshallpracticeinonecertificationbody,andshallnotpracticeintwoormorecertificationbodiesatthesametime.

Article15Inspectioninstitutionsandlaboratoriesthatissuedataandresultsthathaveademonstrativeeffecttothesocietyshallhavethebasicconditionsandcapabilitiesprescribedbyrelevantlawsandadministrativeregulations,andshallnotbealloweduntiltheyhavebeencertifiedinaccordancewiththelaw.Engageincorrespondingactivities,andthecertificationresultsshallbeannouncedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil.

ChapterThree"Certifications

Article16"Thestatepromotesproduct,service,andmanagementsystemcertificationinaccordancewiththeneedsofeconomicandsocialdevelopment.

Article17Thecertificationbodyshallengageincertificationactivitiesinaccordancewiththebasiccertificationstandardsandcertificationrules.ThebasiccertificationstandardsandcertificationrulesshallbeformulatedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil;wherethedutiesoftherelevantdepartmentsoftheStateCouncilareinvolved,thecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilshallformulateinconjunctionwiththerelevantdepartmentsoftheStateCouncil.

Itbelongstoanewfieldofcertification.Ifthedepartmentspecifiedintheprecedingparagraphhasnotformulatedcertificationrules,thecertificationbodycanformulatecertificationrulesbyitselfandreporttothecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilfortherecord.

Article18:Anylegalperson,organizationorindividualmayvoluntarilyentrustalegallyestablishedcertificationbodytoconductproduct,service,andmanagementsystemcertification.

Article19Thecertificationbodyshallnotrefusetoprovidecertificationserviceswithinthebusinessscopeofthecertificationbodyonthegroundsthattheclienthasnotparticipatedincertificationconsultationorcertificationtraining,andshallnotproposetotheclientthatithasnothingtodowithcertificationactivities.Requirementsorrestrictions.

Article20:Certificationbodiesshalldisclosebasiccertificationspecifications,certificationrules,chargingstandardsandotherinformation.

Article21Thecertificationbody,certification-relatedinspectionagenciesandlaboratoriesengagedincertificationandcertification-relatedinspectionandtestingactivitiesshallcompletetheproceduresspecifiedinthebasiccertificationspecificationsandcertificationrulestoensurecertification,Inspectionandtestingarecomplete,objective,andtruthful,andproceduresmustnotbeadded,reduced,oromitted.

Certificationagencies,inspectionagenciesandlaboratoriesrelatedtocertificationshallmakecompleterecordsofthecertification,inspection,andtestingprocesses,andkeepthemonfile.

Article22:Thecertificationbodyanditscertificationpersonnelshallmakeacertificationconclusioninatimelymannerandensurethatthecertificationconclusionisobjectiveandtrue.Thecertificationconclusionshallbesignedbythepersoninchargeofthecertificationbodyafterbeingsignedbythecertificationpersonnel.

Thecertificationbodyanditscertificationpersonnelareresponsibleforthecertificationresults.

Article23Ifthecertificationconclusionisthattheproduct,service,andmanagementsystemmeetthecertificationrequirements,thecertificationbodyshallissueacertificationcertificatetotheclientinatimelymanner.

Article24Thosewhohaveobtainedacertificationcertificateshallusethecertificationcertificateandcertificationmarkwithinthescopeofthecertification,andshallnotusetheproduct,servicecertificationcertificate,certificationmarkandrelatedwordsandsymbolstomisleadthepublicintotheirmanagementThesystemhaspassedthecertification,andthemanagementsystemcertificationcertificate,certificationmarkandrelatedwordsandsymbolsshallnotbeusedtomisleadthepublicintothinkingthatitsproductsandserviceshavepassedthecertification.

Article25Thecertificationbodycandevelopthecertificationmarkbyitself.Thestyle,textandnameofthecertificationmarkformulatedbythecertificationbodyshallnotviolatetheprovisionsoflawsandadministrativeregulations,shallnotbethesameasorsimilartothecertificationmarkpromotedbythestate,shallnothindersocialmanagement,andshallnotharmsocialmorality.

Article26Thecertificationbodyshallimplementeffectivefollow-upinvestigationsonitscertifiedproducts,services,andmanagementsystems.Ifthecertifiedproducts,services,andmanagementsystemscannotcontinuetomeetthecertificationrequirements,thecertificationbodyshallsuspendItisuseduntilthecertificationcertificateisrevokedandannounced.

Article27Inordertoprotectnationalsecurity,preventfraud,protecthumanhealthorsafety,protectthelifeorhealthofanimalsandplants,andprotecttheenvironment,ifthestatestipulatesthatrelevantproductsmustbecertified,theyshallbecertifiedandAfterthecertificationmarkismarked,itcanbeusedinfactory,sale,importorotherbusinessactivities.

Article28:Thestateshallunifyproductcatalogs,unifymandatoryrequirements,standardsandconformityassessmentproceduresoftechnicalspecifications,unifymarks,andunifychargingstandardsforproductsthatmustbecertified.

Theunifiedproductcatalog(hereinafterreferredtoasthecatalog)isformulatedandadjustedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilinconjunctionwithrelevantdepartmentsoftheStateCouncil,issuedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,andimplementedjointlywithrelevantparties.

Article29:ProductslistedinthecatalogmustbecertifiedbythecertificationbodydesignatedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil.

ThecertificationmarksofproductslistedinthecatalogshallbeuniformlyprescribedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil.

Article30Theproductslistedinthecataloginvolvetheinspectioncatalogofimportandexportcommodities,theinspectionproceduresshallbesimplifiedduringtheinspectionofimportandexportcommodities.

Article31ThecertificationbodydesignatedbythecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCounciltoengageinthecertificationactivitiesofproductslistedinthecatalogandthecertification-relatedlaboratories(hereinafterreferredtoasthedesignatedcertificationbodiesandlaboratories)shallItisanorganizationthathasbeenengagedinrelatedbusinessforalongtime,hasnobadrecords,andhasbeenaccreditedinaccordancewiththeprovisionsoftheseregulations,andhastheabilitytoengageinrelatedcertificationactivities.ThecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncildesignatescertificationagenciestoengageinthecertificationactivitiesofproductslistedinthecatalog,andshallensurethatatleasttwoinstitutionsthatmeettherequirementsoftheseregulationsaredesignatedineachareaof​​theproductslistedinthecatalog.

ThecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilshalldesignatethecertificationbodiesandlaboratoriesspecifiedintheprecedingparagraph,andshallannouncerelevantinformationinadvance,andorganizerecognizedexpertsintherelevantfieldstoformanexpertreviewcommitteeforthosethatmeettherequirementsoftheprecedingparagraph.Certificationagenciesandlaboratoriesconductreviews;afterreviewandsolicitingopinionsfromtherelevantdepartmentsoftheStateCouncil,theywillmakedecisionswithinthetimeannouncedinaccordancewiththeprinciplesofrationaluseofresources,faircompetition,andconvenienceandeffectiveness.

Article32ThecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilshallpublishthelistofdesignatedcertificationbodies,laboratoriesanddesignatedbusinessscope.

Unappointedcertificationbodiesandlaboratoriesshallnotengageincertificationofproductslistedinthecatalogandinspectionandtestingactivitiesrelatedtocertification.

Article33:Producers,sellers,andimportersofproductslistedinthecatalogmayentrustadesignatedcertificationbodyforcertification.

Article34Thedesignatedcertificationagencyandlaboratoryshallprovideclientswithconvenientandtimelycertification,inspection,andtestingserviceswithinthedesignatedscopeofbusiness,withoutdelay,andshallnotdiscriminateormakethingsdifficultforclients,Andshallnotseekimproperbenefits.

Thedesignatedcertificationbodyshallnottransferthedesignatedcertificationbusinesstootherorganizations.

Article35ThedesignatedcertificationbodiesandlaboratoriesshallcarryoutinternationalmutualrecognitionactivitieswithintheframeworkoftheinternationalmutualrecognitionagreementsignedbythecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilorauthorizeddepartmentsoftheStateCouncil..

ChapterFour:Accreditation

Article36:Theaccreditationagency(hereinafterreferredtoastheaccreditationagency)determinedbythecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilshallindependentlycarryoutaccreditationactivities.

ExceptfortheaccreditationagencydeterminedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,nootherunitshalldirectlyorindisguiseengageinaccreditationactivities.Whereotherunitsengageinaccreditationactivitiesdirectlyorindisguise,theiraccreditationresultsareinvalid.

Article37Certificationagencies,inspectionagencies,andlaboratoriesmaybeaccreditedbyaccreditationagenciestoensurethattheircertification,inspection,andtestingcapabilitiescontinueandstablymeettheaccreditationconditions.

Article38:Personnelengagedincertificationactivitiessuchasreviewandauditmustberegisteredbyanaccreditationbodybeforeengagingincorrespondingcertificationactivities.

Article39Theaccreditationbodyshallhaveaqualitysystemcommensuratewithitsaccreditationscope,andestablishaninternalauditsystemtoensuretheeffectiveimplementationofthequalitysystem.

Article40Accordingtotheneedsofaccreditation,theaccreditationbodymayselectpersonneltoengageinaccreditationreviewactivities.Personnelengagedinaccreditationreviewactivitiesshouldberecognizedexpertsinrelatedfields,familiarwithrelevantlaws,administrativeregulations,andaccreditationrulesandprocedures,andpossessgoodmoralcharacter,professionalknowledgeandbusinesscapabilitiesrequiredforreview.

Article41Ifanaccreditationbodyentrustsotherstocompletespecificaccreditation-relatedassessmentservices,theaccreditationbodyshallberesponsiblefortheassessmentconclusions.

Article42Theaccreditationbodyshalldisclosetheaccreditationconditions,accreditationprocedures,chargingstandardsandotherinformation.

Theaccreditationbodyacceptsaccreditationapplications,andshallnotmakeanyrequirementsorrestrictionsunrelatedtoaccreditationactivitiestotheapplicant.

Article43Theaccreditationagencyshallcompletethereviewofthecertificationagency,inspectionagency,andlaboratorywithinthetimeofpublication,inaccordancewiththenationalstandardsandtheregulationsofthecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,anddecidewhethertograntThedecisionofaccreditation,andacompleterecordoftheaccreditationprocessshallbekeptonfile.Theaccreditationbodyshallensurethattheaccreditationisobjective,fair,completeandeffective,andberesponsiblefortheaccreditationconclusion.

Theaccreditationbodyshallissueaccreditationcertificatestoaccreditedcertificationbodies,inspectionagencies,andlaboratories,andpublishthelistofaccreditedcertificationbodies,inspectionagencies,andlaboratories.

Article44:Accreditationagenciesshall,inaccordancewiththenationalstandardsandtheregulationsofthecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,conductassessmentsofpersonnelengagedincertificationactivitiessuchasreviewandaudit.Thosewhopasstheassessmentshallberegistered.

Article45Theaccreditationcertificateshallincludetheaccreditationscope,accreditationstandard,accreditationfieldandvalidityperiod.

Article46:Theaccreditedorganizationshallusetheaccreditationcertificateandaccreditationmarkwithinthescopeoftheaccreditation.Iftheaccreditedinstitutionimproperlyusestheaccreditationcertificateandaccreditationmark,theaccreditationinstitutionshallsuspendtheiruseuntiltheaccreditationcertificateisrevoked,andpublishit.

Article47Theaccreditationbodyshallimplementeffectivefollow-upsupervisionofaccreditedinstitutionsandpersonnel,andperiodicallyreviewaccreditedinstitutionstoverifywhethertheycontinuetomeetaccreditationconditions.Iftheaccreditedinstitutionsandpersonnelnolongermeettheaccreditationrequirements,theaccreditationinstitutionshallrevoketheaccreditationcertificateandmakeanannouncement.

Iftherearechangesintheaccreditationconditions,suchasthepractitionersandmainpersonsinchargeoftheaccreditedinstitution,facilities,andself-madecertificationrules,theaccreditationinstitutionshallbenotifiedintime.

Article48Theaccreditationagencyshallnotacceptanyfundingthatmayaffecttheobjectiveandfairnessoftheaccreditationactivity.

Article49Domesticcertificationagencies,inspectionagencies,andlaboratoriesthatareaccreditedbyoverseasaccreditationagenciesshallfilewiththecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncil.

Chapter5SupervisionandAdministration

Article50ThecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilmayorganizepeerreviews,solicitopinionsfromcertifiedcompanies,andconductrandomchecksoncertificationactivitiesandcertificationresults,Requiringcertificationbodies,inspectionagenciesandlaboratoriesrelatedtocertificationtoreportontheirbusinessactivitiestosupervisetheircompliancewiththeseregulations.Anyviolationoftheseregulationsshouldbeinvestigatedanddealtwithinatimelymanner.IfthedutiesoftherelevantdepartmentsoftheStateCouncilareinvolved,therelevantdepartmentsshouldbenotifiedinatimelymanner.

Article51:ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilshallfocusonsupervisingdesignatedcertificationbodiesandlaboratories,andconductregularorirregularinspectionsoftheircertification,inspection,andtestingactivities.ThedesignatedcertificationbodiesandlaboratoriesshallsubmitreportstothecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilonaregularbasis,andshallberesponsiblefortheauthenticityofthereports;thereportsshallexplainthestatusofthecertification,inspectionandtestingactivitiesoftheproductslistedinthecatalog.

Article52TheaccreditationagencyshallregularlysubmitreportstothecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilandberesponsiblefortheauthenticityofthereport;thereportshallbeontheaccreditationagency’simplementationoftheaccreditationsystemandthestatusofaccreditationactivities,Provideanexplanationoftheworksituationofthepractitioners.

ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilshallevaluatetheaccreditationagency’sreportandsupervisetheaccreditationagencybyconsultingtheaccreditationactivityarchivesandobtaininginformationfromrelevantpersonnel.

Article53ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilmay,accordingtotheneedsofcertificationandaccreditationsupervisionandmanagement,inquirethemainpersonsinchargeofaccreditationagencies,certificationagencies,inspectionagencies,andlaboratoriesonrelevantmatters,andinvestigateandunderstandthesituation.,Togiveawarning,therelevantpersonnelshouldactivelycooperate.

Article54Themarketsupervisionandmanagementdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelshallsuperviseandmanagecertificationactivitieswithinthescopeofauthorizationofthecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilinaccordancewiththeprovisionsoftheseregulations.

Themarketsupervisionandmanagementdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelauthorizedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil,hereinafterreferredtoasthelocalcertificationsupervisionandmanagementdepartment.

Article55AnyunitorindividualhastherighttoreportviolationsofcertificationandaccreditationtothecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilandthelocalcertificationsupervisionandmanagementdepartment.ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilandthelocalcertificationsupervisionandmanagementdepartmentshallinvestigateanddealwithitinatimelymanner,andkeepthewhistleblowerconfidential.

ChapterVILegalLiability

Article56Anyonewhoengagesincertificationactivitieswithoutapprovalshallbebannedandimposedafineof100,000yuanto500,000yuan,whichisillegalIftheincomeisobtained,theillegalincomeshallbeconfiscated.

Article57IfanoverseascertificationagencyhasestablishedarepresentativeofficewithintheterritoryofthePeople’sRepublicofChinawithoutregistration,itshallbebannedandafineof50,000yuanupto200,000yuanshallbeimposed.

IfaregisteredrepresentativeagencyofanoverseascertificationagencyengagesincertificationactivitieswithintheterritoryofthePeople’sRepublicofChina,itshallbeorderedtomakecorrectionsandafineof100,000yuanupto500,000yuanshallbeimposed.Ifthereareillegalgains,theillegalgainsshallbeconfiscated;Ifthecircumstancesareserious,theapprovaldocumentshallberevokedandannounced.

Article58Thecertificationbodyacceptsfundingthatmayaffecttheobjectiveandfairnessofthecertificationactivity,orengagesinproductdevelopment,marketingandotheractivitiesthatmayaffecttheobjectivenessandimpartialityofthecertificationactivity,orentrustswiththecertificationWhereapersonhasinterestsinassetsormanagement,itshallbeorderedtosuspendbusinessforrectification;ifthecircumstancesareserious,theapprovaldocumentshallberevokedandannounced;ifthereisillegalincome,theillegalincomeshallbeconfiscated;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.

Article59Ifacertificationbodyhasoneofthefollowingcircumstances,itshallbeorderedtomakecorrections,andafineofnotlessthanRMB50,000butnotmorethanRMB200,000shallbeimposed.Ifthereisanyillegalincome,theillegalincomeshallbeconfiscated;ifthecircumstancesareserious,itshallbeorderedSuspensionofbusinessforrectification,untiltheapprovaldocumentisrevokedandannounced:

(1)Engagingincertificationactivitiesbeyondtheapprovedscope;

(2)Increase,decrease,oromitbasiccertificationstandardsandcertification

(3)Failingtoimplementeffectivefollow-upinvestigationonthecertifiedproducts,services,andmanagementsystems,ordiscoveringthatthecertifiedproducts,services,andmanagementsystemscannotcontinuetomeetthecertificationrequirements,Failuretopromptlysuspenditsuseorrevokethecertificationcertificateandpublishit;

(4)Employingpersonnelwhohavenotbeenregisteredbyanaccreditedinstitutiontoengageincertificationactivities.

Anyincrease,decrease,oromissionofcertification-relatedinspectionagenciesandlaboratoriesinaccordancewiththeproceduresprescribedinthebasiccertificationspecificationsandcertificationrulesshallbepunishedinaccordancewiththeprovisionsoftheprecedingparagraph.

Article60Ifthecertificationbodyhasoneofthefollowingcircumstances,itshallbeorderedtomakecorrectionswithinatimelimit;ifitfailstomakecorrectionswithinthetimelimit,afineof20,000yuanto100,000yuanshallbeimposed:

(一)Refusingtoprovidecertificationserviceswithinthescopeofthecertificationbody’sbusinessonthegroundsthattheclienthasnotparticipatedincertificationconsultationorcertificationtraining,orsubmittingrequirementsorrestrictionstotheclientthatarenotrelatedtocertificationactivities;

(2)Thestyle,textandnameoftheself-developedcertificationmarkarethesameasorsimilartothecertificationmarkpromotedbythestate,orhindersocialmanagement,orharmsocialmorality;

(3)notdisclosedCertificationbasicspecifications,certificationrules,chargingstandardsandotherinformation;

(4)Failuretomakeacompleterecordofthecertificationprocessandkeepitonfile;

(5)FailuretocertifytoitintimeTheclientissuedacertificationcertificate.

Iftheinspectionagencyorlaboratoryrelatedtocertificationfailstomakeacompleterecordoftheinspectionandtestingprocessrelatedtocertification,andkeepitonfile,itshallbepunishedinaccordancewiththeprovisionsoftheprecedingparagraph.

Article61.Ifthecertificationbodyissuesfalsecertificationconclusions,orthecertificationconclusionsissuedareseriouslyinaccurate,theapprovaldocumentshallberevokedandpublished;thedirectlyresponsiblepersoninchargeandthecertificationdirectlyresponsiblePersonnelshallrevoketheirqualifications;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw;ifdamageiscaused,thecertificationbodyshallbearthecorrespondingliabilityforcompensation.

Ifthedesignatedcertificationbodycommitstheillegalactsspecifiedintheprecedingparagraph,thedesignationshallberevokedatthesametime.

Article62Ifacertifierisengagedincertificationactivitiesanddoesnotpractiseatacertificationbodyoratthesametimepractisingattwoormorecertificationbodies,itshallbeorderedtomakecorrections,andshallbegivenapenaltyofsuspendingpracticeformorethan6monthsandlessthan2years.Iftheyfailtomakecorrections,theirqualificationsforpracticeshallberevoked.

Article63If​​certificationbodiesandcertification-relatedlaboratoriesengageinthecertificationofproductslistedinthecatalogandinspectionandtestingactivitiesrelatedtocertificationwithoutdesignation,theyshallbeorderedtomakecorrectionsandimposeapenaltyof100,000yuanIfthefinesabove500,000yuanhaveillegalgains,theillegalgainsshallbeconfiscated.

Ifthecertificationbodyengagesinthecertificationactivitiesoftheproductslistedinthecatalogwithoutdesignation,theapprovaldocumentshallberevokedandannounced.

Article64.Ifthedesignatedcertificationbodyorlaboratoryexceedsthedesignatedbusinessscopeandengagesinthecertificationofproductslistedinthecatalogandinspectionandtestingactivitiesrelatedtocertification,itshallbeorderedtomakecorrectionsandimposeapenaltyofmorethan100,000yuanIfthereisafineoflessthan500,000yuan,theillegalincomeshallbeconfiscated;ifthecircumstancesareserious,thedesignationshallberevokeduntiltheapprovaldocumentisrevoked,anditshallbeannounced.

Ifthedesignatedcertificationagencytransfersthedesignatedcertificationbusiness,itshallbepunishedinaccordancewiththeprovisionsoftheprecedingparagraph.

Article65Certificationagencies,inspectionagencies,andlaboratoriesthathavebeenaccreditedbyoverseasaccreditationagenciesandhavenotfiledwiththecertificationandaccreditationsupervisionandadministrationdepartmentoftheStateCouncilshallbegivenawarningandannounced.

Article66Iftheproductslistedinthecatalogarenotcertified,theyleavethefactory,aresold,importedorusedinotherbusinessactivitieswithoutauthorization,theyshallbeorderedtomakecorrectionsandbefinednotlessthan50,000yuanbutnotmorethan200,000yuan.Ifthereareillegalgains,theillegalgainsshallbeconfiscated.

Article67Ifanaccreditationinstitutionhasoneofthefollowingcircumstances,itshallbeorderedtomakecorrections;ifthecircumstancesareserious,themainresponsiblepersonandresponsiblepersonnelshallberemovedordismissed:

(1)Recognizinginstitutionsandpersonnelthatdonotmeettheaccreditationconditions;

(2)Itisfoundthattheaccreditedinstitutionsandpersonneldonotmeettheaccreditationrequirements,andtheaccreditationcertificateisnotrevokedintime,andtheaccreditationcertificateisannounced;

(3)Acceptingfundingthatmayaffecttheobjectiveandfairnessoftheaccreditedactivity.

Themainpersoninchargeandresponsiblepersonnelofanaccreditationinstitutionthathasbeendismissedordismissedshallnotengageinaccreditationactivitieswithin5yearsfromthedateofdismissalordismissal.

Article68Ifanaccreditationbodyhasoneofthefollowingcircumstances,itshallbeorderedtomakecorrections;themainresponsiblepersonsandresponsiblepersonsshallbewarned:

(1)Accepttheaccreditationapplication,Toproposetotheapplicantrequirementsorrestrictionsthatarenotrelatedtotheaccreditationactivity;

(2)Theaccreditationactivityisnotcompletedwithinthepublishedtime,ortheaccreditationconditions,accreditationprocedures,chargingstandardsandotherinformationarenotdisclosed;

(3)Itisdiscoveredthattheaccreditedinstitutionhasimproperlyusedtheaccreditationcertificateandaccreditationmark,andfailstosuspenditsuseorrevoketheaccreditationcertificateandpublishitintime;

(4)NotcorrectAcompleterecordoftheaccreditationprocessismadeandkeptonfile.

Article69ThecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilandthelocalcertificationsupervisionandmanagementdepartmentsandtheirstaffwhoabusetheirpowers,practicefavoritism,orneglecttheirduties,commitoneofthefollowingacts,shallbedirectlyresponsibletothesupervisorPersonnelandotherdirectlyresponsiblepersonnelshallbegivenadministrativesanctionsofdemotionordismissalaccordingtolaw;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedaccordingtolaw:

(1)Implementationofapprovalanddesignationnotinaccordancewiththeconditionsandproceduresstipulatedintheseregulations

(2)Itisfoundthatthecertificationbodynolongermeetstheapprovalordesignationconditionsstipulatedintheseregulations,andtheapprovaldocumentordesignationisnotrevoked;

(3)ItisfoundthatthedesignatedlaboratorydoesnotIfitmeetsthedesignatedconditionsstipulatedintheseregulations,thedesignationwillnotberevoked;

(4)Itisfoundthatthecertificationbody,thecertification-relatedinspectionagency,andthelaboratoryhaveissuedfalsecertificationandtheinspectionandtestconclusionsrelatedtothecertificationOrtheissuedcertificationandtheinspectionandtestconclusionsrelatedtothecertificationareseriouslyinaccurateandshallnotbeinvestigatedandpunished;

(5)Otherillegalactsofcertificationandaccreditationstipulatedintheseregulationsarediscoveredandshallnotbeinvestigatedandpunished.

Article70Forgery,fraudulentuse,ortradingofcertificationmarksorcertificationcertificatesshallbeinvestigatedandpunishedinaccordancewiththe"ProductQualityLawofthePeople'sRepublicofChina"andotherlaws.

Article71TheadministrativepenaltiesstipulatedintheseRegulationsshallbeimplementedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncilorthelocalcertificationsupervisionandmanagementdepartmentauthorizedbyitinaccordancewiththeirrespectiveduties.Wherelawsandotheradministrativeregulationsprovideotherwise,itshallbeimplementedinaccordancewiththelawsandotheradministrativeregulations.

Article72Within5yearsfromthedateofdisqualificationofthecertificationpersonnel,theaccreditationagencywillnolongeraccepttheirregistrationapplications.

Article73Thecertificationbodyfailstocarryouteffectivefollow-upinvestigationonitscertifiedproducts,orfindsthatitscertifiedproductscannotcontinuetomeetthecertificationrequirements,andfailstosuspendorrevokethecertificationcertificateintimeandrequestittostopusingitIfthecertificationmarkcauseslossestoconsumers,theproducersandsellersshallbejointlyandseverallyliable.

ChapterSevenSupplementaryProvisions

Article74Thequalitymanagementstandardcertificationofpharmaceuticalproductionandoperationenterprises,thequalitycertificationoflaboratoryanimals,thecertificationofmilitaryproducts,andthecalibrationofmilitaryproducts,ThisRegulationdoesnotapplytotheaccreditationoftestinglaboratoriesandtheirpersonnel.

Accordingtotheseregulations,thecertificationbodyapprovedbytheregulationsisengagedinthemanagementsystemcertificationofmining,hazardouschemicals,fireworksandfirecrackersproductionandoperationunits,andisorganizedbytheStateCouncil’ssafetyproductionsupervisionandmanagementdepartmentinconjunctionwiththespecialrequirementsofsafetyproduction;engagedinmining,dangerousThecertificationbodyforthecomprehensiveevaluationofproductionsafetyofchemical,fireworksandfirecrackerproductionandbusinessunitsshallbeapprovedbytheaccreditationbodyonlyafterbeingrecommendedbythesafetyproductionsupervisionandmanagementdepartmentoftheStateCouncil.

Article75Certificationandaccreditationfeesshallcomplywithrelevantnationalpricelawsandadministrativeregulations.

Article76:ThemanagementmeasuresforcertificationtraininginstitutionsandcertificationconsultinginstitutionsshallbeformulatedbythecertificationandaccreditationsupervisionandmanagementdepartmentoftheStateCouncil.

Article77TheseregulationsshallcomeintoforceonNovember1,2003.The"RegulationsofthePeople'sRepublicofChinaontheAdministrationofProductQualityCertification"promulgatedbytheStateCouncilonMay7,1991shallberepealedatthesametime.
