Article1
Inordertostrengthenthesupervisionandmanagementoffoodandotherproductsafety,furtherclarifytheproducers,operators,supervisionandmanagementdepartmentsandlocalpeopleTheresponsibilityofthegovernmentistostrengthenthecoordinationandcooperationofvarioussupervisionandmanagementdepartmentstoprotecthumanhealthandlifesafety.Theseregulationsareformulated.
Article2
Inadditiontofood,theproductsmentionedintheseregulationsalsoincludeedibleagriculturalproducts,medicinesandotherproductsrelatedtohumanhealthandlifesafety.
Forproductsafetysupervisionandmanagement,wherethelawhasprovisions,thelawshallapply;ifthelawdoesnotprovideortheprovisionsareunclear,thisprovisionshallapply.
Article3
Productionandbusinessoperatorsshallberesponsibleforthesafetyoftheproductstheyproduceandsell,andshallnotproduceorsellproductsthatdonotmeetlegalrequirements.
Accordingtolawsandadministrativeregulations,theproductionandsaleofproductsthatrequirealicenseorneedtobecertifiedshallbeengagedinproductionandbusinessactivitiesinaccordancewithstatutoryconditionsandrequirements.Thosewhodonotfollowlegalconditionsandrequirementstoengageinproductionandbusinessactivities,orproduceandsellproductsthatdonotmeetlegalrequirements,shallbesubjecttotheconfiscationofillegalincome,productsandusebythesupervisionandmanagementdepartmentsofagriculture,health,qualityinspection,commerce,industryandcommerce,andpharmaceuticalsinaccordancewiththeirrespectiveduties.Forillegallyproducedtools,equipment,rawmaterialsandotheritems,ifthevalueofthegoodsislessthan5,000yuan,afineof50,000yuanwillbeimposed;ifthevalueofthegoodsismorethan5,000yuanbutlessthan10,000yuan,afineof100,000yuanwillbeimposed;thevalueof10,000yuanIfthevalueismorethanRMBYuan,afineof10timesto20timesthevalueofthegoodsshallbeimposed;ifseriousconsequencesarecaused,theoriginallicenseissuingauthorityshallrevokethelicenselicense;ifitconstitutesthecrimeofillegalbusinessoperationsorthecrimeofproducingorsellingcounterfeitandinferiorgoods,thecriminalshallbeinvestigatedinaccordancewiththelawresponsibility.
Ifaproducerorbusinessoperatornolongermeetsthestatutoryconditionsandrequirementsandcontinuestoengageinproductionandbusinessactivities,theoriginallicense-issuingdepartmentwillrevokethelicense,andannouncethelistoftheproductionandbusinessoperatorswhoselicenseshavebeenrevokedonthemainlocalmedia;
Ifalicenseisrequiredtoobtainalicenseinaccordancewiththelaw,butthelicenseisnotobtainedtoengageinproductionandbusinessactivities,thesupervisionandmanagementdepartmentsofagriculture,health,qualityinspection,commerce,industryandcommerce,andpharmaceuticalsshallconfiscateillegalincomeandproductsaccordingtotheirrespectivedutiesAndtools,equipment,rawmaterialsandotheritemsusedforillegalproduction,ifthevalueofthegoodsislessthan10,000yuan,afineof100,000yuanshallbeimposed;ifthevalueofthegoodsismorethan10,000yuan,thevalueofthegoodsshallbemorethan10timesandlessthan20timesthevalueFine;ifitconstitutesacrimeofillegalbusinessoperations,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.
Relevantindustryassociationsshouldstrengthenindustryself-discipline,supervisetheproductionandoperationactivitiesofproducersandoperators;strengthenthepopularizationandpublicityofpublichealthknowledge,andguideconsumerstochooseproductsproducedandsoldbylegalproducersandoperatorsandhavelegallabelsTheproduct.
Article4
Therawmaterials,auxiliarymaterials,additives,andagriculturalinputsusedbyproducersintheproductionofproductsshallcomplywiththeprovisionsoflaws,administrativeregulationsandnationalmandatorystandards.
Inviolationoftheprovisionsoftheprecedingparagraph,illegaluseofrawmaterials,auxiliarymaterials,additives,andagriculturalinputsshallbeconfiscatedbythesupervisionandmanagementdepartmentsofagriculture,health,qualityinspection,commerce,andpharmaceuticalsinaccordancewiththeirrespectiveduties,andthevalueofthegoodsIfthevalueislessthan5,000yuan,afineof20,000yuanwillbeimposed;ifthevalueofthegoodsismorethan5,000yuanbutlessthan10,000yuan,afineof50,000yuanwillbeimposed;ifthevalueofthegoodsismorethan10,000yuan,thevalueofthegoodswillbe5timesormorethan10timesthevalue.Thefollowingfines;ifseriousconsequencesarecaused,theoriginallicense-issuingdepartmentshallrevokethelicenselicense;ifitconstitutesthecrimeofproducingorsellingfakeandinferiorcommodities,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.
Article5
Thesellermustestablishandimplementapurchaseinspectionandacceptancesystem,verifythesupplier’sbusinessqualifications,verifytheproductqualificationcertificateandproductidentification,andestablishaproductpurchasestationAccount,truthfullyrecordtheproductname,specifications,quantity,suppliersandtheircontactinformation,purchasetime,etc.Asalesenterpriseengagedinproductwholesalebusinessshallestablishaproductsalesledgertotruthfullyrecordthevariety,specifications,quantity,flowdirectionandothercontentsofthewholesaleproduct.Productionenterprisesthatsellself-madeproductsatcentralizedproducttradingvenuesshallperformtheobligationtoestablishproductsalesaccountsinaccordancewiththeregulationsofsalesenterprisesengagedinproductwholesalebusiness.Theretentionperiodofthepurchaseledgerandsalesledgershallnotbelessthan2years.Thesellershallaskthesupplierfortheinspectionreportissuedbytheinspectionagencythatmeetsthestatutoryrequirementsorthecopyoftheinspectionreportsignedorstampedbythesupplieraccordingtotheproductionbatchoftheproduct;productsthatcannotprovidetheinspectionreportorthecopyoftheinspectionreport,Notforsale.
Thosewhoviolatetheprovisionsoftheprecedingparagraphshallbeorderedbytheindustryandcommerceanddrugregulatoryauthoritiestostopsalesinaccordancewiththeirrespectiveduties;thosewhocannotprovideinspectionreportsorcopiesofinspectionreportstosellproductsshallconfiscateillegalincomeandillegallysoldproducts,andAfineof3timesthevalueofthegoodsshallbeimposed;ifseriousconsequencesarecaused,thelicenselicenseshallberevokedbytheoriginallicense-issuingdepartment.
Article6
Theestablishmentofaproductcentralizedtradingmarket,aproductbusinesscounterleasingcompany,andaproductfairorganizershallreviewthebusinessqualificationsofthesellersenteringthemarket,andclarifytheentryTheproductsafetymanagementresponsibilityofmarketsellers,regularinspectionsoftheoperatingenvironment,conditions,internalsafetymanagementsystemandoperatingproductsofthemarketsellerswhethertheymeetthelegalrequirements.Ifthesalesofproductsthatdonotmeetthelegalrequirementsorotherillegalactivitiesarefound,theyshouldbetimelyStopandimmediatelyreporttothelocaladministrationforindustryandcommerce.
Incaseofviolationoftheprovisionsoftheprecedingparagraph,theadministrativedepartmentforindustryandcommerceshallimposeafineofnotlessthan1,000yuanbutnotmorethan50,000yuan;ifthecircumstancesareserious,thebusinessshallbeorderedtosuspendbusinessforrectification;ifseriousconsequencesarecaused,thebusinesslicenseshallberevoked.
Article7
Producersandoperatorsofexportproductsshallensurethattheirexportproductsmeetthestandardsorcontractrequirementsoftheimportingcountry(region).Wherethelawrequiresthattheproductmustbeinspectedbeforeitcanbeexported,itshallbeinspectedandqualifiedbyanagencythatcomplieswiththelaw.
Exportproductinspectionpersonnelshallconductinspectionsinaccordancewithlaws,administrativeregulationsandrelevantstandards,procedures,andmethods,andshallberesponsiblefortheinspectionandverificationformsissuedbythem.
Theentry-exitinspectionandquarantineagencyandthesupervisionandmanagementdepartmentsofcommerceanddrugsshallestablishgoodandbadrecordsoftheproducersandoperatorsofexportedproductsandmakethempublic.Simplifyinspectionandquarantineproceduresforproducersandoperatorsofexportproductswithgoodrecords.
Wheretheproducersandoperatorsofexportproductsevadeproductinspectionorfalsifyproducts,theentry-exitinspectionandquarantineagencyandthedrugsupervisionandadministrationdepartmentshall,inaccordancewiththeirrespectiveduties,confiscatetheillegalgainsandproducts,andimposeafineof3timesthevalueofthegoods;Constituteacrime,beheldcriminallyresponsible.
Article8
Importedproductsshallmeetthemandatoryrequirementsofmycountry’snationaltechnicalspecificationsandtheinspectionrequirementsstipulatedintheagreementssignedbetweenmycountryandtheexportingcountry(region).
Qualityinspectionanddrugsupervisionandmanagementdepartmentsimplementclassifiedmanagementofimportedproductsbasedontheintegrityandqualitymanagementleveloftheproducersandoperators,andtheresultsoftheriskassessmentofimportedproducts,andimplementrecord-keepingfortheconsigneesofimportedproductsmanage.Theconsigneeofimportedproductsshalltruthfullyrecordtheflowofimportedproducts.Therecordretentionperiodshallnotbelessthan2years.
Whenthequalityinspectionanddrugsupervisionandmanagementdepartmentsfindproductsthatdonotmeetthestatutoryrequirements,theycanincludethepurchasers,inspectionapplicants,andagentsoftheproductsthatdonotmeetthestatutoryrequirementsonthelistofbadrecords.Ifthepurchaserorsellerofimportedproductsresortstofraud,thequalityinspectionanddrugsupervisionandmanagementdepartmentsshall,inaccordancewiththeirrespectiveduties,confiscatetheillegalgainsandproducts,andimposeafineofthreetimesthevalueofthegoods;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.Iftheinspectororagentofimportedproductsresortstofraud,theinspectionqualificationshallbecancelledandafineequivalenttothevalueofthegoodsshallbeimposed.
Article9
Ifamanufacturerdiscoversthatitsproductshavehiddensafetyhazards,whichmaycauseharmtohumanhealthandlifesafety,itshallpublishrelevantinformationtothesocietyandnotifythesellertostopForsales,informconsumerstostopusing,taketheinitiativetorecalltheproduct,andreporttotherelevantsupervisionandmanagementdepartment;thesellershouldimmediatelystopsellingtheproduct.Ifasellerdiscoversthattheproducthesellshashiddensafetyhazardsthatmaycauseharmtohumanhealthandlifesafety,heshouldimmediatelystopsellingtheproduct,notifythemanufacturerorsupplier,andreporttotherelevantsupervisionandmanagementdepartment.
Ifmanufacturersandsellersfailtoperformtheobligationsspecifiedintheprecedingparagraph,thesupervisionandmanagementdepartmentsofagriculture,health,qualityinspection,commerce,industryandcommerce,andpharmaceuticalsshallorderthemanufacturerstorecalltheproductsandthesellerstostopsalesinaccordancewiththeirrespectiveduties.,Theproductionenterpriseshallbefinedthreetimesthevalueofthegoods,andthesellershallbefinednotlessthan1,000yuanbutnotmorethan50,000yuan;ifseriousconsequencesarecaused,thelicenseissuedbytheoriginallicenseshallberevoked.
Article10
Thelocalpeople’sgovernmentatorabovethecountylevelshallincorporateproductsafetysupervisionandmanagementintothegovernment’sworkassessmentobjectives,takeoverallresponsibilityforproductsafetysupervisionandmanagementwithintheadministrativearea,andleadunifiedleadership,Coordinatethesupervisionandmanagementworkintheadministrativearea,establishandimprovethesupervisionandmanagementcoordinationmechanism,strengthenthecoordinationandsupervisionofadministrativelawenforcement;unifyleadershipandcommandtheresponsetoproductsafetyemergencies,organizetheinvestigationandpunishmentofproductsafetyincidentsinaccordancewiththelaw;establishsupervisionandmanagementresponsibilitiesSystem,appraisalandassessmentofvarioussupervisionandmanagementdepartments.Thesupervisionandmanagementdepartmentsofqualityinspection,industryandcommerce,andpharmaceuticalsshall,undertheunifiedcoordinationofthepeople'sgovernmentatthesamelevelwheretheyarelocated,doagoodjobinthesupervisionandmanagementofproductsafetyinaccordancewiththelaw.
Ifthelocalpeople’sgovernmentatorabovethecountyleveldoesnotperformtheleadershipandcoordinationresponsibilitiesofproductsafetysupervisionandmanagement,andproductsafetyaccidentsoccurmultipletimesayearintheadministrativearea,whichcausesserioussocialimpact,thesupervisoryauthorityortheappointmentanddismissalagencyshallThemainpersoninchargeofthegovernmentandthepersoninchargewhoaredirectlyinchargeshallbepunishedbydemerit,demotionordismissal.
Article11
Thecompetentdepartmentsofqualityinspection,healthandagricultureoftheStateCouncilshallformulate,modifyordraftrelevantnationalstandardsassoonaspossiblewithintheirrespectiveresponsibilities,andacceleratetheestablishmentofunifiedmanagementandcoordination,Inlinewithreality,scientificandreasonableproductstandardsystem.
Article12
Thepeople'sgovernmentatorabovethecountylevelanditsdepartmentsshallperformsupervisionandmanagementofproductsafetyinaccordancewithstatutoryauthorityandprocedures,andbeopen,fairandjust.Forthesameviolationofthelaw,theproducerandbusinessoperatorshallnotbegivenadministrativepenaltiesofmorethantwofines;ifacrimeissuspectedofconstitutingacrimeandcriminalresponsibilityisrequiredinaccordancewiththelaw,itshallbetransferredtothepublicsecurityorganinaccordancewiththeRegulationsontheTransferofSuspectedCriminalCasesbyAdministrativeLawEnforcementOrgans.
Agriculture,health,qualityinspection,commerce,industryandcommerce,pharmaceuticalsandothersupervisionandmanagementdepartmentsshallsuperviseandinspectproducersandoperatorsinaccordancewiththeirrespectiveresponsibilities,andrecordtheircompliancewithmandatorystandardsandstatutoryrequirements.Fileitafterbeingsignedbythesupervisoryinspector.Thesupervisionandinspectionrecordsshallbeusedasthecontentoftheregularassessmentofthepersoninchargedirectlyincharge.Thepublichastherighttoconsultthesupervisionandinspectionrecords.
Article13
Incaseofanyofthefollowingcircumstances,thesupervisionandmanagementdepartmentsofagriculture,health,qualityinspection,commerce,industryandcommerce,andpharmaceuticalsshalltakemeasuresaccordingtotheirrespectiveduties.,Tocorrectillegalacts,preventorreducetheoccurrenceofharm,andpunishtheminaccordancewiththeseregulations:
(1)Thosewhoshouldobtainalicenseaccordingtolawbuthavenotobtainedalicensetoengageinproductionandbusinessactivities;
(2)Afterobtainingalicenseorcertification,failingtoengageinproductionandbusinessactivitiesinaccordancewithstatutoryconditionsandrequirements,orproducingandsellingproductsthatdonotmeetstatutoryrequirements;
(3)TheproducerandbusinessoperatornolongermeetsthestatutoryrequirementsConditionsandrequirementstocontinuetoengageinproductionandbusinessactivities;
(4)Producersdonotuserawmaterials,auxiliarymaterials,additives,andagriculturalinputsinaccordancewithlaws,administrativeregulationsandnationalmandatorystandardsintheirproducts;
(5)Thesellerhasnotestablishedandimplementedthepurchaseinspectionandacceptancesystem,andestablishedtheproductpurchaseledger;
(6)ThemanufacturerandthesellerdiscovertheproductstheyproduceandsellTherearepotentialsafetyhazards,whichmaycauseharmtohumanhealthandlifesafety,andfailtofulfilltheobligationsofthisregulation;
(7)Producersandoperatorsviolatelaws,administrativeregulationsandotherrelevantprovisionsofthisregulation.
Ifthesupervisionandmanagementdepartmentsofagriculture,health,qualityinspection,commerce,industryandcommerce,drugs,etc.failtoperformthedutiesspecifiedintheprecedingparagraphandcauseconsequences,thesupervisoryauthorityortheappointmentanddismissalagencyshallbethemainpersoninchargeandthedirectlyresponsiblepersoninchargeAndotherdirectlyresponsiblepersonsshallbegivenamajordemeritordemotion;ifseriousconsequencesarecaused,themainpersonincharge,thedirectlyresponsiblepersonincharge,andotherdirectlyresponsiblepersonsshallbegivendismissalorexpelled;themainpersonincharge,thedirectlyresponsiblepersoninchargePersonnelandotherpersonsdirectlyresponsibleforthecrimeofderelictionofdutyshallbeinvestigatedforcriminalresponsibilityinaccordancewiththelaw.
Violationoftheseregulations,abuseofpowerorotherderelictionofduty,thesupervisoryauthorityortheappointmentandremovalagencyshallimposeademeritormajordemeritontheprincipalresponsibleperson,thedirectlyresponsiblepersonincharge,andotherdirectlyresponsiblepersonnel;Ifseriousconsequencesarecaused,themainpersonincharge,thedirectlyresponsiblepersoninchargeandotherdirectlyresponsiblepersonsshallbedegradedordismissed;
Article14
Agriculture,health,Ifthesupervisionandmanagementdepartmentsofqualityinspection,commerce,industryandcommerce,pharmaceuticalsandothersupervisionandmanagementdepartmentsfindviolationsoftheseregulationsandfallwithinthedutiesofothersupervisionandmanagementdepartments,theyshallimmediatelynotifyinwritingandtransferthemtothecompetentsupervisionandmanagementdepartmentsforhandling.Thedepartmentauthorizedtodealwiththemattershalldealwithitimmediatelyandshallnotshirk;iftheconsequencesarecausedbythefailuretodealwithitimmediatelyortheshirk,thesupervisoryorganortheappointmentanddismissalagencyshallrecordthemajordemeritordemotionofthemainpersonincharge,thedirectlyresponsiblepersoninchargeandotherdirectlyresponsiblepersonsPunishment.
Article15
Agriculture,health,qualityinspection,commerce,industryandcommerce,pharmaceuticalsandothersupervisionandmanagementdepartmentsperformtheirrespectiveproductsafetysupervisionandmanagementresponsibilities,andhavethefollowingpowers:
(1)Entertheproductionandbusinesspremisesforon-siteinspection;
(2)Check,copy,sealup,andseizerelevantcontracts,bills,accountbooksandotherrelevantmaterials;
(3)Sealupandseizeproductsthatdonotmeetstatutoryrequirements,illegallyusedrawmaterials,auxiliarymaterials,additives,agriculturalinputs,andtoolsandequipmentusedinillegalproduction;Productionandoperationsiteswithmajorhiddendangerstolifesafety.
Article16
Agriculture,health,qualityinspection,commerce,industryandcommerce,pharmaceuticalsandothersupervisionandmanagementdepartmentsshallestablisharecordsystemforillegalactivitiesofproducersandoperators,anddealwithillegalactivities.Recordandpublish;Forproducersandoperatorswithmultiplerecordsofillegalacts,thelicensewillberevoked.
Article17
Whereaninspectionandtestinginstitutionissuesafalseinspectionreport,causingseriousconsequences,thedepartmentthatgranteditwillrevokeitsinspectionandtestingqualifications;ifacrimeisconstituted,itwillbedirectlyresponsibleThepersoninchargeandotherpersonsdirectlyresponsibleshallbeinvestigatedforcriminalresponsibilityinaccordancewiththelaw.
Article18
Intheeventofaproductsafetyincidentorotherproductsafetyincidentsthathaveaseriousimpactonsociety,thesupervisionandmanagementofagriculture,health,qualityinspection,commerce,industryandcommerce,drugs,etc.Departmentsmustrespondinatimelymannerwithinthescopeoftheirrespectiveduties,takemeasurestocontrolthedevelopmentofthesituation,reducelosses,releaseinformationinaccordancewiththeregulationsoftheStateCouncil,anddoagoodjobintheaftermath.
Article19
Anyorganizationorindividualhastherighttoreportviolationsofthisregulation.Thedepartmentreceivingthereportshallkeepthereporterconfidential.Ifthereportistrueafterinvestigation,thedepartmentthatacceptsthereportshallrewardthereporter.
Agriculture,health,qualityinspection,commerce,industryandcommerce,pharmaceuticalsandothersupervisionandmanagementdepartmentsshallpublishtheemailaddressorreporttelephonenumberoftheirunit;thereportsreceivedshallberecordedinatimelyandcompletemannerandproperlypreserved.Ifthereportedmatterbelongstotheresponsibilityofthedepartment,itshallbeacceptedandverified,handledandrespondedinaccordancewiththelaw;ifitdoesnotbelongtotheresponsibilityofthedepartment,itshallbetransferredtothedepartmentauthorizedtohandleit,andtheinformantshallbenotified.
Articletwentieth
Theseregulationsshallcomeintoforceonthedateofpromulgation.
ContentInterpretation
