Forproductsthatareexemptfrom3Ccertification,themanufactureroragentshouldapplytotheChinaNationalCertificationSupervisionandAdministrationCommissionandsubmitthecertificationmaterialsthatmeettheexemptionconditions.

Thefirstarticleistoregulatecompulsoryproductcertification,improvecertificationeffectiveness,andsafeguardnational,socialandpublicinterests.Accordingtothe"RegulationsonCertificationandAccreditationofthePeople’sRepublicofChina"(hereinafterreferredtoasCertificationandAccreditationRegulations)andotherlaws,administrativeregulationsandrelevantnationalregulations,formulatetheseregulations.
Article2Inordertoprotectnationalsecurity,preventfraud,protecthumanhealthorsafety,protectanimalandplantlifeorhealth,andprotecttheenvironment,relevantproductsspecifiedbythestatemustbecertified(hereinafterreferredtoascompulsoryproductcertification))Andmarkedwiththecertificationmarkbeforeitcanbeusedinfactory,sale,importorotherbusinessactivities.
Article3:TheGeneralAdministrationofQualitySupervision,InspectionandQuarantine(hereinafterreferredtoastheGeneralAdministrationofQualitySupervision,InspectionandQuarantine)isinchargeofthenationalcompulsoryproductcertification.
TheNationalCertificationandAccreditationAdministration(hereinafterreferredtoastheNationalCertificationandAccreditationAdministration)isresponsiblefortheorganization,implementation,supervisionandmanagementandcomprehensivecoordinationofthenationalcompulsoryproductcertification.
Localqualityandtechnicalsupervisiondepartmentsatalllevelsandlocalentry-exitinspectionandquarantineagencies(hereinafterreferredtoaslocalqualityinspectionandquarantinebureaus)areresponsibleforthesupervision,managementandlawenforcementofcompulsoryproductcertificationactivitiesintheirjurisdictionsinaccordancewiththeirrespectivedutiesInvestigatework.
Article4Forproductssubjecttocompulsoryproductcertification,thestateshallunifytheproductcatalog(hereinafterreferredtoasthecatalog),unifythemandatoryrequirements,standardsandconformityassessmentproceduresofthetechnicalspecifications,unifythecertificationmarks,andunifythechargingstandards.
TheGeneralAdministrationofQualitySupervision,InspectionandQuarantineandtheNationalCertificationandAccreditationAdministrationofthePeople'sRepublicofChinaandtherelevantdepartmentsoftheStateCouncilformulateandadjustthecatalog.
Article5Thestateencouragesthedevelopmentofequalandmutuallybeneficialinternationalmutualrecognitionactivitiesforcompulsoryproductcertification.ThemutualrecognitionactivitiesshallbeconductedintheinternationalmutualrecognitionactivitiessignedbytheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,CNCA,orrelevantdepartmentsauthorizedbythem.Withintheframeworkoftheagreement.
Article6:Institutionsandtheirpersonnelengagedincompulsoryproductcertificationactivitiesshallbeobligedtokeepconfidentialthetradesecrets,productiontechnology,craftsmanshipandothertechnicalsecretsandinformationtheyknowaboutintheirbusinessactivities.
ChapterIIImplementationofCertification
Article7ThebasicnormsforcompulsoryproductcertificationshallbeformulatedandissuedbytheGeneralAdministrationofQualitySupervision,InspectionandQuarantineandtheCNCA.Thecertificationrulesforsexualproducts(hereinafterreferredtoascertificationrules)areformulatedandpromulgatedbytheCNCA.
Article8Compulsoryproductcertificationshallapplythefollowingsinglecertificationmodeoracombinationofmultiplecertificationmodes.Thespecificmodesinclude:
(1)Designappraisal;
(2)Typetest;
(3)Sampletestingorinspectionattheproductionsite;
(4)Marketsamplingtestorinspection;
(5)Enterprisequalityassuranceabilityandproductconsistencyinspection;
(6)Follow-upinspectionaftercertification.
Theproductcertificationmodelshouldbebasedontheperformanceoftheproduct,andthecomprehensivefactorsrelatedtopublicsafety,humanhealthandenvironment,thelifecycleoftheproduct,theriskstatusofproduction,andtheriskofimportedproducts,etc.Theprinciplesofscienceandconveniencearedetermined.
Article9certificationrulesshouldincludethefollowing:
(1)Applicableproductrange;
(2)Applicableproductscorrespondingtonationalstandards,Themandatoryrequirementsofindustrystandardsandnationaltechnicalspecifications;
(3)Certificationmode;
(4)Principlesorregulationsforthedivisionofapplicationunits;
(5)Samplingandsampledeliveryrequirements;
(6)Confirmationrequirementsforkeycomponentsorrawmaterials(whenneeded);
(7)Requirementsfortestingstandards(whenneeded);
(8)Requirementsforfactoryinspection;
(9)Requirementsforfollow-upinspectionafterobtainingthecertificate;
(10)Requirementsforthevalidityperiodofthecertification;
(11)Requirementsforthecertificationmarkofcertifiedproducts;
(12)Otherregulations.
Article10Producersorsellersandimportersofproductslistedinthecatalogue(hereinaftercollectivelyreferredtoascertificationprincipals)shallentrustcertificationbodiesdesignatedbytheCNCA(hereinafterreferredtoascertificationbodies)fortheirproduction,Salesorimportedproductsarecertified.
Ifotherenterprisesareentrustedtoproduceproductslistedinthecatalog,theentrustingenterpriseortheentrustedenterprisemayentrustcertificationtothecertificationbody.
Article11Thecertificationprincipalshallproviderelevanttechnicalmaterialstothecertificationbodyinaccordancewiththespecificproductcertificationrules.
Whenthesellerorimporteristhecertificationprincipal,theyshouldalsoprovidethecertificationbodywithacopyoftherelevantcontractconcludedbetweenthesellerandthemanufacturerortheimporterandthemanufacturer.
Ifotherenterprisesareentrustedtoproducetheproductslistedinthecatalog,thecertificationclientshallalsoprovidethecertificationbodywithacopyoftherelevantcontractbetweentheentrustingenterpriseandtheentrustedenterprise.
Article12:Afterthecertificationbodyacceptsthecertificationentrustment,itshallarrangeproducttypetestsandfactoryinspectionsinaccordancewithspecificproductcertificationrules.
Article13Thecertificationclientshallensurethatthesamplesitprovidesareconsistentwiththeactualproductsproduced,andthecertificationbodyshallreviewtheauthenticityofthesamplesprovidedbythecertificationclient.
Thecertificationbodyshall,inaccordancewiththerequirementsofthecertificationrules,andaccordingtotheproductcharacteristicsandactualconditions,adoptsamplingmethodssuchassampledeliverybythecertificationclient,on-sitesampling,orsampledeliverybythecertificationclientafteron-sitesealing.ThelaboratoriesdesignatedbyCNCA(hereinafterreferredtoaslaboratories)conductproducttypetestsonsamples.
Article14Whenconductingproducttypetestsonsamples,laboratoriesshallensurethatthetestconclusionsaretrueandaccurate,andshallmakeacompleterecordoftheentiretestprocess,fileitforretention,andensurethattherecordsofthetestprocessandresultsareavailable.Traceability,cooperatewiththecertificationbodytocarryouteffectivefollow-upinspectionofcertifiedproducts.
Laboratoryandrelatedpersonnelshallberesponsibleforthecontentofthetestreportandtestconclusionsitmakes.Ifthereareobjectionstotheauthenticityofthesample,theyshallexplainthesituationtothecertificationbodyanddealwithitaccordingly.
Article15Ifafactoryinspectionisrequired,thecertificationbodyshallappointacompulsoryproductcertificationinspectorwithnationalregistrationqualificationstoensurethatthequalityassuranceabilityoftheproductmanufacturerandtheconsistencybetweentheproductandthetypetestsampleInaccordancewiththespecificproductcertificationrules,theinspectionshallbecarriedout.
Thecertificationbodyanditscompulsoryproductcertificationinspectorsshallberesponsiblefortheinspectionconclusions.
Article16Afterthecertificationbodycompletestheproducttypetestandfactoryinspection,ifitmeetsthecertificationrequirements,itwillgenerallyissueacertificationcertificatetothecertificationclientwithin90daysofacceptingthecertificationentrustment.
Ifthecertificationrequirementsarenotmet,thecertificationclientshallbenotifiedinwritingandthereasonsshallbeexplained.
Thecertificationbodyanditsrelatedpersonnelshallberesponsibleforthecertificationconclusionstheymake.
Article17Thecertificationbodyshallimplementclassifiedmanagementandeffectivetrackingofcertifiedproductsandtheirmanufacturingenterprisesbymeansofon-siteproducttestingorinspection,marketproductsamplingtestingorinspection,qualityassuranceabilityinspection,etc.Check,controlandverifytheconsistencybetweenthecertifiedproductandthetypetestsample,andthequalityassuranceabilityofthemanufacturercontinuestomeetthecertificationrequirements.
Article18Thecertificationbodyshallmakeacompleterecordofthewholeprocessoffollow-upinspection,fileitandkeepit,toensurethetraceabilityofthecertificationprocessandresults.
Forthosewhocannotcontinuetomeetthecertificationrequirements,thecertificationbodyshallsuspendorrevokethecertificationcertificateaccordingtothecorrespondingsituation,andannounceit.
Article19Thecertificationbodyshall,inaccordancewiththeprovisionsofthecertificationrules,determinethesafetylevelofthecertifiedproduct,thestabilityoftheproductquality,andthegoodandbadrecordsoftheproductmanufacturer.Anditsproductionenterprisescarryoutclassifiedmanagementoffollow-upinspections,anddeterminereasonablefollow-upinspectionfrequencies.
ChapterIIICertificationCertificatesandCertificationMarks
Article20TheNationalCertificationandAccreditationAdministrationofChinauniformlystipulatesthecompulsoryproductcertificationcertificate(hereinafterreferredtoasthecertificationcertificate)Theformatandcontentofthecompulsoryproductcertificationmark(hereinafterreferredtoasthecertificationmark)styleandtype.
Article21Thecertificationcertificateshallincludethefollowingbasiccontent:
(1)Thenameandaddressofthecertificationprincipal;
(2)Productproducer(Manufacturer)nameandaddress;
(3)thenameandaddressoftheentrustedproductioncompany(whennecessary);
(4)productnameandproductseries,specifications,andmodels;
(5)Certificationbasis;
(6)Certificationmode(whenneeded);
(7)Issuingdateandvalidityperiod;
>(8)Issuingauthority;
(9)Certificatenumber;
(10)Othercontentthatneedstobemarked.
Article22Thevalidityperiodofthecertificateis5years.
Thecertificationbodyshall,basedonitsfollow-upinspectionofthecertifiedproductanditsmanufacturingenterprise,indicateonthecertificationcertificatethequerywebsiteandtelephonenumberfortheeffectivestatusoftheannualinspection.
Ifthevalidityperiodofthecertificationcertificateexpiresanditneedstobeusedforrenewal,thecertificationclientshallapplyfortheapplicationwithin90daysbeforethevalidityperiodofthecertificationcertificateexpires.
Article23Thecontentofthecertificationcertificatemarkedonthecertifiedproductanditssalespackageshallbeconsistentwiththecontentofthecertificationcertificateandcomplywiththerelevantnationalregulationsonproductlabelingmanagement.
Article24Inoneofthefollowingsituations,thecertificationclientshallapplytothecertificationbodyforthechangeofthecertificationcertificate,andthecertificationbodyshallmakecorrespondinghandlingaccordingtodifferentsituations:
(1)Ifthenamingmethodofthecertifiedproductischangedresultinginthechangeoftheproductname,model,orthenameofthemanufacturer,manufacturer,oraddressofthecertifiedproduct,thecertificationcertificateshallbechangedafterverificationbythecertificationbody;
(2)Themodelofthecertifiedproductischanged,butdoesnotinvolvechangesintheinternalstructureofsafetyperformanceandelectromagneticcompatibility;orifthecertifiedproductreducesthemodelofthesameproduct,thecertificationcertificatewillbechangedafterconfirmationbythecertificationbody;
(3)Ifthekeycomponents,specificationsandmodelsofthecertifiedproduct,aswellasthedesign,structure,processandmaterialorrawmaterialmanufacturerinvolvedinthesafetyofthewholemachineorelectromagneticcompatibilityarechanged,thecertificationcertificateshallbechangedafterthecertificationbodyisre-testedandqualified;
(4)Ifthelocationofthecertifiedproductmanufactureroritsqualityassurancesystem,productionconditions,etc.arechanged,thecertificationcertificateshallbechangedafterthecertificationbodypassesthefactoryinspectionagain;
(5)Othercircumstancesthatshouldbechanged.
Article25Ifacertificationclientneedstoextendthecoverageofitscertifiedproduct,itshallapplytothecertificationbodyfortheextensionofthecertificationcertificate.Thecertificationbodyshallchecktheconsistencyoftheextendedproductwiththeoriginalcertifiedproduct.Confirmthevalidityoftheoriginalcertificationresultfortheextendedproduct.Afterthequalificationisconfirmed,thecertificationcertificatemaybeissuedseparatelyorre-issuedaccordingtotherequirementsofthecertificationclient.
Certificationbodiescansupplementproducttypetestsorfactoryinspectionsfordifferencesinaccordancewiththerequirementsofthecertificationrules.
Article26Inoneofthefollowingcircumstances,thecertificationbodyshallcancelthecertificationcertificateandannounceittothepublic:
(1)ThevalidityperiodofthecertificationcertificateexpiresandthecertificationclienthasnotappliedforitContinueduse;
(2)Thecertifiedproductisnolongerinproduction;
(3)Thecertifiedproductmodelhasbeenincludedinthecatalogofproductsthatareexplicitlyeliminatedorprohibitedbythestate;
(4)Thecertificationclientappliesforcancellation;
(5)Othercircumstancesthatshouldbecancelledaccordingtolaw.
Article27Inoneofthefollowingsituations,thecertificationbodyshallsuspendthecertificationcertificatewithinthetimelimitspecifiedinthecertificationrulesandannounceittothepublic:
(1)CertificationapplicabletotheproductThebasisorthecertificationrulesarechanged,andtheproductfailstomeetthechangerequirementswithinthespecifiedtimelimit;
(2)Thecertificationclientisfoundtoviolatethecertificationrulesandotherregulationsduringthefollow-upinspection;
(3)Refusingtoacceptfollow-upinspectionwithoutjustifiedreasonsorthefollow-upinspectionfindsthattheproductcannotcontinuetomeetthecertificationrequirements;
(4)Thecertificationclientappliesforsuspension;
(5)OtherlegallyrequiredCircumstancesofsuspension.
Article28Inanyofthefollowingcircumstances,thecertificationbodyshallrevokethecertificationcertificateandannounceittothepublic:
(1)Thereisadefectinthecertifiedproduct,whichleadstoaqualitysafetyaccident
(2)Inthefollow-upinspection,itisfoundthatthecertifiedproductisinconsistentwiththesampleprovidedbythecertificationclient;
(3)Duringthesuspensionofthecertificationcertificate,thecertificationclienthasnottakenrectificationAfterthemeasuresorrectificationsarestillunqualified;
(4)Thecertificationclientobtainsthecertificationcertificatebyfraud,briberyandotherimpropermeans;
(5)Otherthingsthatshouldberevokedaccordingtolawsituation.
Article29:Whereacertifiedproductiscancelled,suspendedorwithdrawn,thecertificationbodyshalldeterminethecategoryandscopeoftheproductthatdoesnotmeetthecertificationrequirements.
Fromthedateofcancellationorrevocationofthecertificationcertificateorduringthesuspensionperiodofthecertificationcertificate,productsthatdonotmeetthecertificationrequirementsshallnotcontinuetobeshipped,sold,importedorusedinotherbusinessactivities.
Article30Thestyleofthecertificationmarkconsistsofabasicpatternandcertificationtypelabel.Thebasicpatternisasfollows:
Inthebasicpattern,"CCC"isfor"ChinaCompulsoryCertification"TheabbreviationoftheEnglishname"ChinaCompulsoryCertification".
Article31:Markthecertificationtypeontherightsideofthebasicpatternofthecertificationmark,whichiscomposedofabbreviationsofEnglishwordsrepresentingthecertificationtypeoftheproduct.
Accordingtotheneedsofcompulsoryproductcertification,theCNCAhasformulatedspecificrequirementsforthelabelingofcertificationtypes.
Article32Thecertificationclientshallestablishacertificationmarkusemanagementsystem,truthfullyrecordandarchivetheuseofthecertificationmark,andpublicizetheproductanditspackaging,advertising,productintroduction,etc.inaccordancewiththecertificationrules.Thecertificationmarkiscorrectlyusedandmarkedinthematerials.
Article33Nounitorindividualmayforge,alter,fraudulentlyuse,tradeortransfercertificationcertificatesandcertificationmarks.
ChapterIVSupervisionandManagement
Article34Certification,inspectionandtestingofcertificationagencies,inspectionagenciesandlaboratoriesbyCNCATheactivitiesimplementannualsupervisionandinspectionandirregularspecialsupervisionandinspection.
Article35Thecertificationbodyshallsendthecertificationprincipalofthecertifiedproduct,thecertifiedproductanditsmanufacturingenterprise,andtheinformationonthecancellation,suspensionorrevocationofthecertificationtotheCNCAandtheprovince.Thetwolocalqualityinspectionbureausatthelocallevelwillreport.
Article36:AccordingtotheunifiedplanoftheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,theStateCertificationandAccreditationAdministrationwilladoptregularorirregularmethodstosuperviseandinspectcertifiedproducts.
Producers,sellers,importersandusersofcertifiedproductsshallnotrefusetosuperviseandinspect.
TheNationalCertificationandAccreditationAdministrationestablishesasystemforpublishingcertifiedproductsandtheirproducers,andannouncestheresultsofsupervisionandinspectiontothepublic.
Article37Thetwolocalqualityinspectionbureausshallsuperviseandinspectcompulsoryproductcertificationactivitiesintheirjurisdictionsinaccordancewiththeirrespectiveduties,andinvestigateanddealwithillegalacts.
Iftheproductslistedinthecataloghavenotbeencertified,buthavenotyetleftthefactoryorsold,thelocalqualityinspectionandinspectionbureausshouldwarntheirproductmanufacturerstocarryoutcompulsoryproductcertificationinatimelymanner.
Article38Whenthetwolocalqualityinspectionbureausconductcompulsoryproductcertificationsupervisionandinspection,theymayentertheproductionandbusinesspremisesaccordingtolawtoconducton-siteinspections,consultandcopyrelevantcontracts,bills,accountbooksandothermaterials.Sealupordetainuncertifiedproductsorproductsthatdonotmeetcertificationrequirements.
Article39Producersandsellersofproductslistedinthecatalogueshalldiscloserelevantinformationtothesocietyiftheydiscoverthattheproductstheyproduceandsellhavehiddensafetyhazardsthatmaycauseharmtohumanhealthandlifesafety,Taketheinitiativetotakeremediessuchasrecallingproducts,andreporttorelevantsupervisionandmanagementdepartmentsinaccordancewithrelevantregulations.
Iftheproducersandsellersoftheproductslistedinthecatalogfailtofulfilltheobligationsstipulatedintheprecedingparagraph,theGeneralAdministrationofQualitySupervision,InspectionandQuarantineshallinitiatetheproductrecallprocedure,ordertheproducertorecalltheproduct,andthesellertostopsellingtheproduct.
Article40Entry-exitinspectionandquarantineagenciesshallimplemententryverificationmanagementforimportedproductslistedinthecatalog,checkcertificationcertificates,certificationmarksandothersupportingdocuments,andcheckwhetherthegoodscertificatesareconsistent.Iftheverificationfails,itshallbedealtwithinaccordancewithrelevantlawsandregulations,andfollow-upsupervisionofimportedproductslistedinthecatalogshallbeimplemented.
Article41Inboundarticleslistedinthecataloguemeetoneofthefollowingcircumstances,nocompulsoryproductcertificationisrequireduponentry:
(1)Foreignembassies,ArticlesforpersonaluseofconsulatesorinternationalorganizationsinChinaandtheirdiplomaticpersonnel;
(2)ArticlesforpersonaluseofofficialagenciesofthegovernmentsofHongKongandMacaoSpecialAdministrativeRegionsintheMainlandandtheirstaff;
(3)Articlesforpersonalusebroughtbytheentrantsfromabroad;
(4)Articlesaidedanddonatedbyforeigngovernments;
(5)OtherproductsthatdonotneedtobecompulsoryaccordingtolawCircumstancesofcertification.
Article42Inanyofthefollowingcircumstances,theproducer,importer,selleroragentoftheproductlistedinthecatalogmayapplytothelocalentry-exitinspectionandquarantineagencyforexemptionfromcompulsoryProductcertificationapplication,submitrelevantcertificationmaterials,liabilityguaranteeletter,productconformitystatement(includingtypetestreport)andothermaterials,andconductproducttestingasneeded,andobtainthe"CertificateofExemptionfromCompulsoryProductCertification"afterapproval.Importedandusedinaccordancewiththedeclaredpurpose:
(1)Productsrequiredforscientificresearchandtesting;
(2)Partsrequiredfortheintroductionofproductionlinesforassessmenttechnology;

(3)Productsdirectlyrequiredforend-usermaintenancepurposes;
(4)Equipment/parts(excludingofficesupplies)requiredforthefactoryproductionline/completeproductionline;
p>(5)Productsthatareonlyusedforcommercialdisplaybutnotforsale;
(6)Products(includingexhibits)thatneedtobereturnedafterbeingtemporarilyimported;
(7)Partsimportedbygeneraltradeforthepurposeofexportingthewholemachine;

(9)Othercircumstancesexemptedfromcompulsoryproductcertificationduetospecialpurposes.
Article43Ifcertificationbodies,inspectionagencies,andlaboratorieshaveoneofthefollowingcircumstances,theCNCAshallorderthemtosuspendbusinessforrectification,andduringtherectificationperiod,theyshallnotengageincompulsoryproductcertificationwithinthedesignatedscope.,Inspectionandtestingactivities:
(1)Increase,decrease,omitorchangetheproceduresstipulatedinthebasiccertificationspecificationsandcertificationrules;
(2)ProductsthathavenotbeencertifiedImplementeffectivefollow-upinvestigation,orfindthatthecertifiedproductscannotcontinuetomeetthecertificationrequirements,andfailtosuspendorrevokethecertificationcertificateintimeandpublishit;
(3)Failuretocompletethecertification,inspection,andtestingprocessRecords,archivesandretention,thecircumstancesareserious;
(4)Theuseofpersonnelwhohavenotobtainedthecorrespondingqualificationsforcertification,inspection,andtestingactivities,thecircumstancesareserious;

Article44Inanyofthefollowingcircumstances,theCNCAmayrevokethedesignationofcertificationbodies,inspectionagencies,andlaboratoriesattherequestoftheinterestedpartyoraccordingtoitspowers:
(1)Staffmembersabusetheirpowersorneglecttheirdutiestomakedesignateddecisions;
(2)Gobeyondtheirstatutorypowerstomakedesignateddecisions;
(3)ViolatelegalproceduresMakingadesignateddecision;
(4)Approvingthedesignationofcertificationbodies,inspectionagencies,andlaboratoriesthatdonothavethedesignatedqualifications;
(5)Othersthatcanrevokethedesignateddecisionaccordingtolawsituation.
Article45Ifthecertificationbody,inspectionagencyorlaboratoryobtainsthedesignationbyfraud,briberyorotherimpropermeans,theCNCAshallrevokethedesignationandannounceit.
Thecertificationbody,inspectionagencyorlaboratoryshallnotapplyfordesignationagainwithin3yearsfromthedateofcancellationofthedesignation.
Article46Personsengagedincompulsoryproductcertificationactivitieswhoissuefalseoruntrueconclusionsandfabricatefalseorfalsedocumentsorrecordsshallberevokedtheirpracticequalifications;within5yearsfromthedateofrevocation,ThecertificationpersonnelregistrationagencyoftheChinaCertificationandAccreditationAssociationnolongeracceptsitsregistrationapplications.
Article47Ifthecertificationclienthasobjectionstothecertificationdecisionofthecertificationbody,hecanappealtothecertificationbody.Ifhestillhasobjectionstotheresultofthecertificationbody,hecanappealtotheCNCA.
Article48AnyunitorindividualhastherighttoreportviolationsoflawsandregulationsincompulsoryproductcertificationactivitiestotheGeneralAdministrationofQualitySupervision,InspectionandQuarantine,theStateCertificationandAccreditationAdministration,orlocalqualityinspectionbureaus.TheGeneralAdministrationofProcuratorialInspection,theStateCertificationandAccreditationAdministrationorthelocalqualityinspectionbureausshallinvestigateanddealwithitinatimelymanner,andkeepthereporterconfidential.
Chapter5PenaltyProvisions
Article49Theproductslistedinthecataloguehavenotbeencertified,andhavebeenshipped,sold,importedorotherwiseoperatedwithoutauthorization.ThoseusedinactivitiesshallbepunishedbythetwolocalqualityinspectionbureausinaccordancewithArticle67oftheCertificationandAccreditationRegulations.
Article50Aftertheproductslistedinthecataloguearecertified,theydonotfollowthestatutoryconditionsandrequirementstoengageinproductionandbusinessactivitiesorproduceandsellproductsthatdonotmeetthestatutoryrequirements.TheSpecialProvisionsoftheStateCouncilonStrengtheningtheSupervisionandAdministrationofFoodandOtherProducts’SafetyshallbedealtwithinArticle2andArticle3,paragraph2.
Article51violatesthesecondparagraphofArticle29oftheseregulations.Duringtheperiodofcancellation,revocationorsuspensionofthecertificationcertificate,productsthatdonotmeetthecertificationrequirementsshallcontinuetobeshipped,sold,importedorotherwiseThoseusedinbusinessactivitiesshallbepunishedbythelocalqualityinspectionbureausinaccordancewithArticle67oftheCertificationandAccreditationRegulations.
Article52,inviolationofArticle42oftheseregulations,fabricatedfalsematerialstodefraudthe"CertificateofExemptionfromCompulsoryProductCertification"orproductsafterobtainingthe"CertificateofExemptionfromCompulsoryProductCertification"Ifitisnotusedinaccordancewiththeoriginaldeclaredpurpose,theentry-exitinspectionandquarantineagencyshallorderittomakecorrections,revokethe"CertificateofExemptionfromCompulsoryProductCertification",andimposepenaltiesinaccordancewithArticle67oftheCertificationandAccreditationRegulations.
Article53Wherethecertificationcertificateisforged,altered,leased,loaned,fraudulentlyused,tradedortransferred,thelocalqualityinspectionandinspectionbureaushallorderittomakecorrectionsandimposeafineof30,000yuan.
Ifthecertificationmarkistransferredorresold,thelocalqualityinspectionandinspectionbureaushallorderittomakecorrectionsandimposeafineoflessthan30,000yuan.
Article54Inanyofthefollowingcircumstances,thelocalqualityinspectionandinspectionbureaushallorderittomakecorrectionsandimposeafineoflessthan30,000yuan:(1)ViolationoftheseregulationsThefirstparagraphofArticle13stipulatesthatthesamplesprovidedbythecertificationclientareinconsistentwiththeactualproducts;
(2)ViolatingtheprovisionsofArticle24oftheseregulationsandfailingtoapplytothecertificationbodyinaccordancewiththeregulationsChangeofcertificationcertificate,factory,sale,import,oruseofproductslistedinthecataloginotherbusinessactivities;Extendingthecertificationcertificate,leavingthefactory,selling,importing,orusingthelistedproductsinotherbusinessactivitieswithoutauthorization.
Article55:Inanyofthefollowingcircumstances,thelocalqualityinspectionandinspectionbureausshallorderthemtomakecorrectionswithinatimelimit,andiftheyfailtomakecorrectionswithinthetimelimit,afineoflessthan20,000yuanshallbeimposed.
(1)InviolationofArticle23oftheseregulations,thecontentofthecertificationcertificatemarkedonthecertifiedproductanditssalespackageisinconsistentwiththecontentofthecertificationcertificate;
(2)ViolatingtheprovisionsofArticle32oftheseregulationsandfailingtousethecertificationmarkinaccordancewiththeregulations.
Article56Ifthecertificationbody,inspectionagency,orlaboratoryissuesfalseconclusionsortheconclusionsissuedareseriouslyinaccurate,theCNCAshallrevoketheirdesignation;Personsdirectlyresponsibleshallberevokedcorrespondingpracticequalifications;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw;iflossesarecaused,correspondingcompensationliabilitiesshallbeassumed.
Article57Ifacertificationbody,inspectionagency,orlaboratoryhasoneofthefollowingcircumstances,theCNCAshallorderittomakecorrections.Ifthecircumstancesareserious,thedesignationshallberevokeduntiltheapprovaldocumentofthecertificationbodyisrevoked.
(1)Engaginginthecertificationofcatalogproductsandtestingandinspectionactivitiesrelatedtocertificationbeyondthedesignatedbusinessscope;
(2)Transferringthedesignatedcertificationbusiness;
(3)Continuetoengageincompulsoryproductcertification,inspection,andtestingactivitieswithinthedesignatedscopeduringtheperiodofbusinessclosureforrectification;
(4)Aftertheperiodofbusinessclosureforrectification,theinspectionstillfailstomeettherequirementsRectificationrequirements.
Article58TheNationalCertificationandAccreditationAdministrationandthelocalqualityinspectionbureausandtheirstaffwhoabusetheirpowers,practicefavoritism,orneglecttheirdutiesshallbegivenadministrativesanctionsaccordingtolaw;ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedaccordingtolaw.
Article59:Forotherillegalactivitiesincompulsoryproductcertificationactivities,penaltiesshallbeimposedinaccordancewithrelevantlawsandadministrativeregulations.
ChapterVIAttachedRules
Article60:Compulsoryproductcertificationshallbechargedinaccordancewithrelevantnationalregulations.
Article61TheGeneralAdministrationofQualitySupervision,InspectionandQuarantineisresponsiblefortheinterpretationofthisregulation.
Article62TheseregulationsshallcomeintoforceonSeptember1,2009.The"ManagementRegulationsonCompulsoryProductCertification"promulgatedbytheGeneralAdministrationofQualitySupervision,InspectionandQuarantineonDecember3,2001shallberepealedatthesametime.
Inspectionrequirements
CCCBasicfactoryinspectionrequirements
ThefirstfactoryistoguaranteecertificationThefirstpersonresponsibleforproductcompliancewithproductcertificationimplementationrules.
Article2Thefactoryshallproducecertifiedproductsconsistentwiththequalifiedsamplesconfirmedbythecertificationbodyinaccordancewiththeproductcertificationimplementationrulesandthefactory'squalityassurancecapabilityrequirements.
Article3Thefactoryshallkeepabreastoftheinformationandrequirementsintheonlinepublicdocumentsofthecertificationbody.
Article4Thefactoryshallestablishandmaintainatleastthefollowingdocumentedproceduresorregulations,andthecontentshallbecompatiblewiththefactoryqualitymanagementandproductqualitycontrol:
(1)Certificationmark
(2)Productchangecontrolprocedures;

Article5Thefactoryshallkeepatleastthefollowingqualityrecordstoverifythatthefactoryhasindeedcarriedoutallproductioninspectionsandproductiontests.Thequalityrecordsshallbetrueandeffective:
(1)Recordsofsupplierselection,evaluationanddailymanagement;
(2)Purchaseinspection/verificationrecordsofkeycomponentsandmaterialsandqualificationcertificatesprovidedbysuppliers;
(3)Productroutineinspectionandconfirmationinspectionrecords;
(4)Inspectionandtestequipmentregularcalibrationorverificationrecords;
(5)RoutineinspectionandConfirmtherecordsofinspectionequipmentoperation;
(6)Disposalrecordsofnonconformingproducts;
(7)Recordsofinternalaudit;
(8)Recordsofcustomercomplaintsandcorrectiveactionstaken;
(9)Periodicconfirmationandinspectionrecordsofpartsandcomponents;
(10)Recordsofimplementationofsigns;
(11)Recordsofnon-conformitycorrectionofoperationalinspections;
Theretentionperiodofrecordsshouldnotbelessthanthetimeintervalbetweentwoinspections,thatis,atleast24months,toensurethatalltherecordsgeneratedafterthisinspectionRecordscanbefoundinthenextinspection.
Article6Thefactoryshallcooperatetocompletethefactoryinspectionactivitiesarrangementsmadebythecertificationbody.Fortheinitialfactoryinspection,thefactoryshouldconductthefactoryinspectionaccordingtotheplannedtimeagreedwiththecertificationbody;forthesupervisionandinspection,thefactoryshouldacceptthesupervisionandinspectionofthecertificationbodywithinthespecifiedtimelimit.Atthesametime,thecertificationbodycanfollowtheinternationalpracticewithoutpriornotice.Incaseoffactorysupervisionandinspection(suchasunannouncedinspection,specialsupervisionandinspection),thefactoryshallcooperate.Otherwise,thecertificationbodyhastherighttosuspendthecertificationcertificate.
Article7Thefactoryshallallowinspectorstoenterallareasinvolvedinproductcertificationforsamplingorinspection,readrelevantrecordsandinterviewrelevantpersonnel(ifthereareareasthatneedtobekeptconfidential,theyshallreporttothecertificationbody).
Article8Thefactoryshouldcooperatewiththeinspectionteamtoconducton-sitedesignatedtestsbasedontheproductcharacteristicsandthespecificconditionsofthefactory.Theon-sitedesignatedtestsarecarriedoutbythefactorywhentheinspectionteamwitnessesthem.
Article9Thefactoryshouldcooperatewiththeinspectionteamtochecktheconsistencyoftheproduct.Ifthedisassemblyofthewholemachineisinvolvedintheinspectionprocess,thefactoryshouldarrangeforpersonneltoperformit.
Article10Duringfactoryinspection,ifthecertifiedproductchangesorisinconsistent,thefactoryshouldtaketheinitiativetoexplaintotheinspectionteam.
Article11Whentheproductneedstobesampled,thefactoryshouldcooperatewiththeinspectionteamtosealthesamplesonsiteandsendthesamplestothedesignatedtestingagencywithinthespecifiedtime.
Article12Thefactoryshallprovidenecessaryworkconvenienceforinspectors.
Article13Thefactoryshallcommunicatewiththelicenseetopromptlypaythesupervisionandinspectionfee(includingthedailyfeeforthesupervisoryreviewerandthedailyfeeforthepasser-by),theannuityandtheproductsupervisionandsamplinginspectionfee(ifany).
Article14Thefactoryshallnotreleasethefollowingproducts:
(1)Non-conformingproducts;
(2)Changeafterobtainingthecertificate,butwithoutProductsconfirmedbythecertificationbody;
(3)Productsthathaveexceededthevalidityperiodofthecertification;
(4)Productslistedincertificatesthathavebeensuspended,cancelled,orrevoked;
(5)Whenthefactoryinspectionconclusionisjudgedtobeon-siteverificationorfailure,theinspectorasksthefactorytosealthecertifiedproductsonthespot.
Article15Thefactoryshallpromptlynotifythecertificationbodyofthechangeofcontactinformation.
CCCexemption
WhatproductsareexemptfromCCC?
1.Thosewhomeetthefollowingconditionsdonotneedtoapplyforcompulsoryproductcertification.
1.Articlesforpersonalusebyforeignembassies,consulatesandinternationalorganizationsinChinaandtheirdiplomats;
2.ArticlesforpersonalusebyofficialagenciesoftheHongKongandMacaoSpecialAdministrativeRegionGovernmentsintheMainlandandtheirstaff;
3.Articlesforpersonalusebroughtbytheimmigrationpersonnelfromabroad;
4.Intergovernmentalassistanceandgifts.
Productsinthe"Catalog"thatmeettheaboveconditionsdonotneedtoapplyforacompulsoryproductcertificationcertificate,nordotheyneedtoapplytheChinesecompulsoryproductcertificationmark.
2.Thosewhomeetthefollowingconditionscanbeexemptedfromapplyingforcompulsoryproductcertification.
1.Productsneededforscientificresearchandtesting;
2.Introducethepartsandcomponentsrequiredbytheproductionlinefortheassessmenttechnology;
3.Productsdirectlyneededforend-usermaintenancepurposes;
4.Equipment/partsrequiredforthefactoryproductionline/completeproductionline(excludingofficesupplies);
5.Productsthatareonlyusedforcommercialdisplay,butnotforsale;
6.Products(includingexhibits)thatneedtobereturnedandshippedoutofcustomsafterbeingtemporarilyimported;
7.Partsimportedbygeneraltradingmethodsforthepurposeofexportingtheentiremachine;
8.Importedpartsorpartsprocessedbyimportedmaterialsforthepurposeofexportingtheentiremachine.
ForproductsintheCataloguethatmeettheaboveconditions,manufacturers,importers,sellersortheiragentscanapplytotherelevantqualityinspectionagency,andsubmitrelatedapplicationsandcertificationsthatmeettheexemptionConditionalcertificationmaterials,liabilityguaranteeletter,productconformitystatement(includingtypetestreport)andothermaterialscanonlybesold,importedandusedinbusinessactivitiesafterbeingapprovedtoobtainthe"CertificateofExemptionfromCompulsoryProductCertification".
3.Productsinthe"Catalog"thathaveoneofthefollowingconditionsshallbepunishedinaccordancewiththe"RegulationsonCertificationandAccreditationofthePeople'sRepublicofChina"andsupportingregulations.
1.Thosewhodonotmeettherequirementsofthisannouncementbutdonotneedtoapplyforcompulsoryproductcertificationwithoutauthorizationforex-factorysales,importanduseinbusinessactivities;
2.Thosewhomeettherequirementsofthisannouncementbuthavenotobtainedthe"CertificateofExemptionfromCompulsoryProductCertification"withoutauthorizationforfactorysales,importanduseinbusinessactivities;
3.Fabricatingfalsematerialstodefraudthe"CertificateofExemptionfromCompulsoryProductCertification";
4.Itisnotusedaccordingtotheoriginalapplicationpurposeafterobtainingthe"CertificateofExemptionfromCompulsoryProductCertification".
Applicationprocess
Forenterpriseapplication,theapplicationformcontainsrelevantinformationabouttheapplicant,manufacturer,manufacturerandproduct.Eachtypeofproductshouldbeappliedforseparately.Productsfromdifferentmanufacturersofthesamemodelshouldalsobeappliedforseparately.
Phase1:ApplicationAcceptance
Afterreceivingtheapplicationthatmeetstherequirements,CQCwillissueanacceptancenoticetotheapplicanttonotifytheapplicanttosendorposttherelevantDocumentsandinformation.Theapplicationphasebecomes1.
Atthesametime,CQCsendsrelevantchargesandnotices.

Aftertheapplicanthaspaid,pleasefillinthepaymentvoucherasrequired.
Stage2:Documentreview
Inthedocumentreviewstage,theproductcertificationengineerneedstodividetheapplicationunit.
Aftertheunitisdivided,ifsampletestingisrequired,theproductcertificationengineersendsasampledeliverynoticeandcorrespondingpaymentnoticetotheapplicant,andatthesametime,informstheapplicanttosendasampleacceptancenoticetothecorrespondingtestingagency.
Stage3:Receiptofthesampledelivered
Thesampleshallbedelivereddirectlytothedesignatedtestinginstitutionbytheapplicant.
Aftertheapplicanthaspaid,pleasefillinthepaymentvoucherasrequired.
Thetestingagencywillcheckandacceptthesamplesreceivedbythecall,fillinthesampleacceptancereport,andissueasamplerectificationnoticeforunqualifiedsamples,andfillinthesampleacceptancereportafterrectification.
Afterthesampleisaccepted,thetestingorganizationfillsinthesampletestingprogresstableandsubmitsittoCQC.
Afterreceivingthesampletestingprogress,CQCwillissueaformalacceptancenoticetotheapplicantafterconfirmingthattheapplicant’srelevantfeeshavebeenpaid,andthetestingagencywillissuethetestingtaskletter,andthesampletestingwillofficiallystart.
Stage4:SampleTest
Duringthesampletestprocess,fornon-conformitiesthatappear,theapplicantshouldmakecorrectionsinaccordancewiththesampletestcorrectionnotice.
Afterthesampletestisover,thetestingagencywillfillinthesampletestresultnotification.
ThetestingagencywillalsosendtestreportsandotherdatatoCQC.
Stage5:FactoryInspection

Customsdeclaration,inspectiondeclarationa)Theapplicantforthepurchaseofthesafetymarksubmitsanapplicationforthepurchaseofthemarktothecertificationcenter.Thecontentshouldinclude:
1)theapplicant,themanufacturer,andthecontactperson;customsdeclarationInspectiondeclaration,foreignexchangeverification,exporttaxrebate,customsclearanceconsultation
2)Productnameandmodel;
3)ThenumberoftheCCCproductcertificationcertificateobtainedbytheproduct;
4)Numberofsignspurchased;customsdeclaration,inspectiondeclaration
5)Applicant'spaymentmethodandsignissuancemethod;customsdeclaration,inspectiondeclaration
6)companysealorauthorizationPeoplesign.
Applicantsforcustomsdeclarationandinspectioncanalsoobtainthe"ApplicationforPurchaseMark"fromthecertificationcenter,fillitoutandreturnittothecertificationcenter.Ifitispurchasedbyanagent,theapplicant'spowerofattorneymustalsobeattached.Thecostofthelogoisrequiredtopurchasethelogo.Thecertificationcentersendsthelogototheapplicantortheapplicantdirectlycollectsthelogo.
Aftertheprinted/moldedlogoproducthasobtainedtheCCCproductcertification,theapplicantcanapplyfortheCCCsafetylabel
tobeprintedontheproductnameplate,orthelogocanbemoldedontheproduct.Theapplicantsubmitsanapplicationtothecertificationcenter,whichshouldincludethefollowingcontent:
1)Applicant,manufacturer,contactperson;customsdeclaration,inspectiondeclaration.
2)Productnameandmodel;customsdeclaration,inspectiondeclaration
3)ThenumberoftheCCCproductcertificationcertificateobtainedbytheproduct,andacopyofthecertificateifnecessary;
4)Factorynumber:
Moldedorprinteddesignpatterns;
6)Companysealorauthorizedperson’ssignature.
Customsdeclarationandinspectionapplicantscanalsorequestaprinted/moldedlogoapplicationformfromthecertificationcenter,andreturnittothecertificationcentertogetherwiththemoldedorprinteddesignpatternafterfillingitout.Thecertificationcentershallreviewthelogoprinting/moldingapplicationsubmittedbytheapplicantaccordingtothefollowingrequirements:
1.Theformatandcontentofthenameplateshouldbeconsistentwiththenameplatesentwhenapplyingforcertification;
2.ThepatternofthesafetymarkshouldbethesameastheCCCmarkorbeenlarged/reducedproportionally:andthesizeshouldnotbesosmallthatitisunrecognizable.
3.Thereshouldbethemanufacturer'snumberorthecorrespondingcertificationnumberoftheproductunderthesafetymark.
Ifthedesigndoesnotmeettherequirements,thecertificationcenterwillnotifytheapplicantandpointoutthecorrespondingchangemeasures.Theapplicantcanreapplyafterchangingthedesignpattern.Afterthedesignpatternmeetstherequirements,afterthecertificationcenterapprovesit,theapplicantwillsend10nameplates(orphotocopies)tothecertificationcenterandpaytheprinting/moldingmarkapprovalfee.Itwillbeissuedafterapprovalbythecertificationcenter,andthenoticeofprinting/moldingmarksisallowed.
